A complaint received regarding a Surfboard repairs business

Dear Dunedin City Council,
On the 23rd of November 2015 I received a personally addressed letter dated 20th of November 2015 from a Senior Planner for the Monitoring and Enforcement Section of the Dunedin City Council, confirming business activities regarding the repairing of surfboards at [home address redacted], Kew, Dunedin. I e-mailed a response on the 23rd of November 2015 confirming these activities, which fit within the Dunedin City Council regulations and I also requested a copy of any complaints made in regards to these activities. On the 24th of November 2015 I received an E-mail reply stating these activities fit within the regulations and the matter would be filed. The Senior Planner informed me that they were unable to disclose the details of the complaint and they state all complaints are confidential.

The Senior Planner has therefore confirmed there has been a compliant made about this business which bares my personal name and I respectfully request a copy of this complaint whether it be verbal, written or some other form.

Dear Dunedin City Council,
I am writing in regards to an Official Information Act request I made on the 24th of November 2015. This request related to a complaint involving a surfboard repair business located at [home address redacted] Kew Dunedin. By Law this request should have been responded to by the 22nd of December 2015 however no response has been offered by the Dunedin City Council whatsoever.

I respectfully ask that this request is attended to as soon as possible. I accept that we are in a holiday period with Christmas and new years, I will take this into consideration.

Dear Jeremy

Thank you for the email. The staff who deal directly with LGOIMAs are on leave and so I am not able to answer your substantive request.
On checking our records, it shows that we extended the timeframe to respond to your request by 20 working days from the original due date of 22 Dec 2015.
Unfortunately it seems that you did not receive the notification of the extension and I apologise for this. I will follow that matter up with the team on their return.

Given I am not in a position to resolve the request until staff return, I need to formally advise that the timeframe for responding to your request for information has been extended by 20 working days (from the original due date of 22 December 2015) as a proper response cannot be made within the original timeframe and as such a response will be provided on or before 11 Feb 2016. I note that the days from 25 Dec 2015 – 15 Jan 2016 do not constitute working days under the LGOIMA provisions.

Given that I have advised of an extension, you are entitled to have the decision to extend the time reviewed by the Office of the Ombudsman.
