David Benson-Pope refers to emails sent by Lee Vandervis to two council staff members that were “abusive & totally offensive" can I request copies of these emails and all information & correspondence related to those emails under the OIA?

I’m happy to receive these emails with the names of those natural persons redacted as I’m only interested in the body and content of said emails.

If you refuse I will of course be asking the ombudsman to review it.

Dear Robert

 

As per my letter the Council declines to provide the e-mails to protect
protection of privacy of natural persons.  You do have the right to seek a
review of the decision by the Office of the Ombudsman.

As I believe it’s in the public interest, which supersedes that particular clause, you leave me no choice but to ask the ombudsman to intervene.

Due to the refusal I’ve made a complaint to the ombudsman today.

I believe the emails are in the public interest to be released as they have previously been cited both in council meetings and media and therefore it is in the public interest for them to be released.
Public interest supersedes the particular clause that the DCC is citing.
Not only that but correspondence between publicly elected officials and civil servants should be discoverable by the public they serve.

Due to the upcoming elections this year I believe this is a matter of urgency as it speaks directly to the suitability of those elected to council.

Also not surprising but absolutely cynical to wait to the last hour on the last day to send a reply refusing the info.

Try asking them to copy and paste into a reply, the offending sentences. And also ask which agencies were contacted to report IE NZ police. In my experience, ombudsman is as much use as mammaries on a bull.

Office of the Ombudsman about the information requested being declined.

 

Subsequent to our decision to withhold the information requested, we have
become aware that the emails you referred to have been made publicly
available through a facebook group by other parties.  In light of this, we
have decided to release the information to you.  Please find attached the
emails requested.  I note that the redaction in the attached document
relates to an email not requested by you.
