Dear Ms Morgan

Thank you for your request of 22 October 2015, asking for the following information under the Official Information Act 1982 (the Act):

1. The total numbers of malpractice/misconduct claims and the resultant costs per year for acupuncture, chiropractic and osteopathic practitioners.

2. Please also provide the same for the science-based medical sector as a comparison.

We have identified information that may fall within the scope of your request. However, we require clarification before being able to fully respond to you.

ACC does not use the terms ‘malpractice’ and ‘misconduct’ for the purposes of classifying claims or injuries. However, the Corporation does provide cover for Treatment Injuries. A Treatment Injury is defined as a personal injury that has occurred during treatment provided by, or at the direction of, one or more registered health professionals. Could you please clarify whether this is what you are referring to in the first question?

We also require a clarification of what you consider to be encompassed by “science-based medical sector.” It would be helpful if you could provide a list of occupations that interest you.

Please also specify the period of time that interests you.

Once ACC has received a request for specific official information, it will acknowledge the request and begin to consider its decision under the Act. The 20 working days for making a decision on your request will begin from the day ACC receives the particulars of your request.

I missed reading the request to clarify what I meant by "science-based medical sector" and respond with that clarification as being inclusive of the following as per the approved treatment providers for ACC:

- audiologists
- counsellors
- dentists
- medical laboratory technologists
- medical practitioners
- nurses
- nurse practitioners
- occupational therapists
- optometrists
- physiotherapists
- podiatrists
- speech therapists.
