Dear S Curtis,

 

Publication of the full opinion of an Ombudsman will not be appropriate in
every case. This reflects the requirements in sections [1]18(2) and [2]21
of the Ombudsmen Act 1975 that an Ombudsman’s investigation shall be
conducted in private and that the Ombudsmen and staff are to maintain
secrecy. An Ombudsman has a discretion (see also section 21 Ombudsmen Act)
to publish information about the investigation but this is not something
which happens as a matter of course.

 

It is not intended that the opinion of the Chief Ombudsman be published in
respect of the case you have mentioned. However, a case note summarising
the key issues, analysis and findings is being prepared. It is anticipated
that this will be finalised before the end of the month. Once the case
note has been published, it will be available on our website. You will be
advised when this has occurred and, should you prefer, a copy will be
forwarded to you by email.

 

You made your request via the website [3]fyi.org.nz as a request under the
Official Information Act. You may wish to note that the Office of the
Ombudsman is not subject to the Official Information Act. Whilst the
Office welcomes enquiries from members of the public, for the avoidance of
doubt, this response should not be treated as a response under the terms
of the OIA.
