Process for reappointment of Crown Entity CEOs

Dear Public Service Commission,

I would like to request any guidance provided by the PSC to crown entities about the process boards should go through to determine whether to reappoint CEOs after their 5 year terms have expired. I am particularly interested in:
- any guidance around the process for determining whether to reappoint the CEO;
- any guidance as to whether the process should include an assessment as to whether the CEO was still suitable for the role;
- any expectation that a transparent process is undertaken, or that reappointments are publicly disclosed; and
- any oversight by, or engagement with, PSC as part of the process.

I note over the last year four CEOs have had their terms extended, without any public information about the process undertaken, and in almost all cases without any public notification of the extensions. This includes the CEOs of: Broadcasting Commission | NZ on Air; Fire and Emergency; Real Estate Authority; and NZ Qualifications Authority.

I would further like to request a summary from the Boards of these four entities outlining:
- the process undertaken to determine to reappoint the CEOs;
- the factors taken into account in making that decision, including whether ongoing suitability was assessed;
- whether any external advice, or feedback, was sought to support the decision. This includes, but is not limited to, whether stakeholder feedback was sought (including from staff); and
- how, if at all, the reappointment was communicated to staff, stakeholders, and the public.

Thank you for your request under the Official Information Act 1982
transferred to NZQA on 22 September 2025 seeking the following
information:

 

            I note over the last year four CEOs have had their terms
extended, without any public information about the process undertaken, and
in almost all cases without any public notification of the extensions.
This includes the   CEO of the NZ Qualifications Authority.

 

I would further like to request a summary from the NZQA Board outlining:

- the process undertaken to determine to reappoint the CEO;

- the factors taken into account in making that decision, including
whether ongoing suitability was assessed;

- whether any external advice, or feedback, was sought to support the
decision. This includes, but is not limited to, whether stakeholder
feedback was sought (including from staff); and

- how, if at all, the reappointment was communicated to staff,
stakeholders, and the public.

 

You can expect to receive a response to your request on or before 20
October 2025. You will be contacted again if there is a likelihood that
this timeframe cannot be met.

 

As you may know requests for official information become official
information once received.  As part of the processing of requests for
official information, NZQA may need to consult with relevant third
parties.  During the consultation, a third party may ask for the identity
of the individual/organisation requesting the information. If you are an
individual making a request, please advise us whether or not you would
have an objection to disclosing your identity if a third party asks for
your identity, and the reasons for your objection.  If you are an
individual making a request on behalf of an organisation please advise us
both whether you personally have an objection to disclosing your identity,
and the reasons for your objection, as well as any objection to
identifying the organisation, together with reasons. NZQA will consider
your reasons and whether they fit with any withholding grounds under the
Privacy Act 2020 or the Official Information Act 1982.

 

Requests from an organisation for information about the organisation will
be processed under Part 4 of the Official Information Act.

We write in respect of your Official Information Act 1982 (OIA) request
made to the Public Service Commissioner (PSC) on 16 September 2025. The
PSC partially transferred the following portion of your request to Fire
and Emergency on 22 September:

Section 12 of the OIA provides that requests may only be made by:

 

o a New Zealand citizen or permanent resident
o a person who is in New Zealand
o a body corporate that is either incorporated in New Zealand; or
o a body corporate that has a place of business in New Zealand

 

For Fire and Emergency to consider your request as one under the OIA, can
you please provide evidence that you meet any of the criteria as noted in
section 12 so we can make a determination of your eligibility to make a
request under the OIA.

 

You may wish to provide any of the following:

 

o a copy of your New Zealand passport
o a copy of your New Zealand driver’s licence
o a copy of a recent utility bill (or other documentation addressed to
you) that evidences your residential address in New Zealand; or
o a copy of information that evidences you’re currently in New Zealand
