Penguins in council plans

Dear Waimate District Council,

Please supply the following information under the Official Information Act (OIA) / Local Government Official Information and Meetings Act (LGOIMA):

Does council agree penguins exist on beaches in their area?
Does council agree penguins are adversely affected?
Have they got plan objectives concerning them? (biodiversity, fauna) or similar?
Have they got plan policies concerning them? (biodiversity, fauna) or similar?
Have they got plan rules concerning them? (biodiversity, fauna) or similar?
If not rules, do they have other methods concerning them?
If any of the above plan matters apply, is it monitoring them?
Has it acted on monitoring?
Are there dog control bylaws over beach areas?

Does council agree penguins exist on beaches in their area? Council holds
no specific records on penguins in the district. We note that publicly
available information (e.g. Inaturalist) does not indicate any colonies in
Waimate District, but our biodiversity officer notes that penguins may be
transient users of the coastline.

Does council agree penguins are adversely affected? We are unsure what you
mean by adversely affected, and note that a LGOIMA request cannot require
a council to generate information or require council to form an opinion. 

Have they got plan objectives concerning them? (biodiversity, fauna) or
similar? (see below)

Have they got plan policies concerning them? (biodiversity, fauna) or
similar? (see below)

Have they got plan rules concerning them? (biodiversity, fauna) or
similar? (see below)

If not rules, do they have other methods concerning them?

For the above four questions, Council has objectives, policies and rules
which relate to biodiversity. The relevant matters can be found in Section
4 (Rural) of the Waimate District Plan, which is available here.

If any of the above plan matters apply, is it monitoring them? Has it
acted on monitoring? Council monitors the plan and the exercise of
resource consents under the plan. As we have no specific records
concerning penguins and no specific plan matters concerning penguins,
Council has no relevant records available to respond to this question. We
note that Environment Canterbury, given its role to manage the coastal
marine area may have relevant records which relate to the Waimate
District.

Are there dog control bylaws over beach areas? Waimate District Council’s
dog control bylaw is part of the Consolidated Bylaw. Information on dogs
in the district, including a link to the bylaw is available online here
[7]Dogs - Waimate District Council. Compliance is required with the bylaw
across the district. If you are interested in areas where dogs are
prohibited, these areas can be found in Appendix 3 of the bylaw.
