I refer to your official information request dated 17 July 2025 requesting information associated with
infringement number 9026240732.
Turning Access Clarification: Could you please confirm what legal and safe options are available for
drivers turning left from Broadway into Clovernook Road, given the adjacent lane is marked for
straight-through traffic only? How can a driver make this turn without briefly entering the bus lane?
Drivers may enter a bus lane and travel up to 50 metres before turning into a side road, a driveway or
another lane.
How many infringement notices have been issued at this specific location (Broadway turning left into
Clovernook Rd) in the past two calendar years (2024 and 2025 to date)?
In enforcement zone BW3 (Broadway /Edgerley Ave - Clovernook Rd) for the period between 1 January
2024 - 30 June 2025 a total of 5,601 infringements have been issued.
How many of these notices were issued to drivers who entered the bus lane briefly for the purpose of
turning left?
In order to provide you this information, we would have to review footage of each infringement to see
if the driver turned left and this would take a substantial amount of time. Therefore, your request is
declined under section 17(f) of the LGOIMA as the requested information cannot be made available
without substantial collation
What is the total amount col ected in fines from this location during that period?
We have issued $840,150 worth of bus lane infringements between 1 January 2024 - 30 June 2025.
When we receive payment, it is not referenced against the enforcement zone to which it was issued.
Therefore, we are unable to provide you the total amount collected in fines from this location without
substantial collation and your request is declined under section 17(f) of the LGOIMA.
Bus Lane Signage and Clarity: Are there any plans to improve signage, road markings, or road layout
at this intersection to make it clearer for drivers whether a left turn is permitted and how it should be
executed safely?
The signage and road markings currently comply with legal requirements, and there are no scheduled
plans for improvements. Maintenance of road markings will be conducted as necessary.
How frequently are enforcement cameras in this location tested or calibrated?
CCTV used is not surveillance certified equipment therefore calibration is not required.
Therefore, this part of your request is declined under Section 17(e) of the LGOIMA as the information
you are requesting does not exist.
What is the process for verifying or manual y reviewing footage before a fine is issued?
The evidence (CCTV footage) held by Auckland Transport is viewed by a Warranted Officer to determine
if an offence took place. Each enforcement zone of a Special Vehicle Lane is set up between two fixed
points, called an Ingress and an Egress respectively. The Ingress is the entry point of the enforcement
zone, and the Egress is the exit point of the enforcement zone. The distance between the two points of
an enforcement zone is measured using a calibrated measuring wheel and is measured in meters. Only
when a vehicle travels through the ingress, middle part/scene of the zone and the egress continual y is
an offence committed, and an infringement issued.
Consideration for Local Access: Has Auckland Transport conducted any assessment or considered
whether this enforcement approach might discourage access to local businesses, including Westfield
Newmarket? If so, could you please share those findings or reports?
No assessments have been completed. Therefore, your request is declined under section 17(e) of
LGOIMA as the requested information does not exist.
Discretion and Context in Infringements: Under what circumstances does Auckland Transport
consider exercising discretion or withdrawing an infringement notice for brief, low-risk bus lane entry
made solely for turning into a legal destination?
Infringement disputes are considered on a case-by-case basis taking the evidence and the information
supplied by the liable party into consideration.
Should you believe that we have not dealt with your request appropriately, you are able to make a
complaint to the Office of the Ombudsman in accordance with section 27(3) of the LGOIMA Act and
seek an investigation and review regarding this matter.
