Dear Auckland Council,

I am writing to request the following information under the Official Information Act 1982:

1. A comprehensive list of:
a) All buildings within Auckland Council's jurisdiction that have been determined to be dangerous, affected, or insanitary (as defined under Section 121-123 of the Building Act 2004) from January 1, 2020 to present; AND
b) Any buildings determined to be dangerous, affected, or insanitary prior to January 1, 2020 that still have active notices, unresolved issues, or ongoing Council oversight as of January 1, 2020 or any time thereafter.

For each building identified, please provide:
- The building's address and/or legal description
- The date the building was determined to be dangerous, affected, or insanitary
- The specific classification (dangerous, affected, or insanitary) and the reasons for this determination
- Which specific powers under Section 124(2) of the Building Act 2004 were exercised by Council, including:
* Whether hoarding or fencing was erected [s124(2)(a)]
* Whether warning notices were attached [s124(2)(b)]
* Whether work notices were issued [s124(2)(c)]
* Whether entry restriction notices were issued [s124(2)(d)]
- The current status of each building, including:
* Whether the issues have been resolved
* If resolved, the date of resolution
* If not resolved, the current state of compliance with any notices issued
- Whether any court orders under Section 126 were sought or obtained

If possible, please provide this information in a machine-readable format (such as CSV or Excel).

We apologise for the delay in acknowledging your request. We received a
high volume of requests during the Christmas shutdown period which ended
on 10 January 2025, and unfortunately your request was missed whilst
clearing the backlog.

 

 We have attached an information sheet on our processes and requirements
under the Local Government Official Information and Meetings Act 1987.

 

We will respond to your request as soon as possible, bearing in mind that
the LGOIMA deadline of 11 February 2025 has passed.
