From: Miss W. Forest
Dear University of Waikato
Attn OIA Admin,
Re: https://fyi.org.nz/request/28762-cv-and-...
Please provide the reasoning how did you refuse the request pursuant to Official Information Act 1982 ("OIA") and not solely by Privacy Act which you cannot rely on when dealing with OIA request.
In particular please explain the consideration why s. 9 of OIA applies. I believe you can only withhold the information if the very limited specific clauses apply -- together considering the public interest.
I find it hard to believe that releasing a CV and cover letter of a high level public official who has been otherwise publizised e.g. through recent Waikato memo release and who was later overturned publicly by both the minister and chief executive of Health NZ relating to public policy guidance about supremacy of english language in the society.
Please re-consider and please provide the reasons why did you refuse to provide the public information.
Yours sincerely,
Miss W. Forest

In order for the Ombudsman to progress your OIA complaint, please email us
at [1][email address] quoting the case reference number
018694, and providing a means by which we can contact you direct. An
Ombudsman’s investigation is conducted in private (rather than on a public
platform such as FYI), and there are some statutory restrictions on the
Ombudsman’s ability to disclose information more widely (see sections
18(2) and 21 of the Ombudsmen Act 1975). The Ombudsman will not take any
action until we hear from you directly.

I have complained to the Ombudsman. I do not think they understand the requirements of s.9 to apply.
