In view of the Ombudsman's decision around the Gore District Council having to release information on the payout conditions of its former CEO Steve Parry could the Christchurch City Council please inform what was the payout agreed with Dawn Baxendale on her resignation from the Christchurch City Council last year.

Dear Marc,

 

I refer to your request below.

 

As you know the Council has previously refused to disclose this
information.

 

At this point we consider our previous decision still stands to refuse
this request under the following sections of the LGOIMA:

 

•  information which is subject to an obligation of confidence (section
7(2)(c)(ii)); and

•  the privacy of natural persons (section 7(2)(a)).

 

The Council considers that the interests in withholding this information
are not outweighed by other considerations which render it desirable, in
the public interest, to make the information available.

 

Notwithstanding the above, please note that pursuant to section 33(1) of
the Local Government Act 2022, the Council annually publishes (in its
annual report):

o the amount of any severance payments made in the year to any person
who vacated office as the chief executive of the local authority  
o the number of employees to whom, in the year, severance payments were
made; and
o the amount of every such severance payment (although this statutory
disclosure obligation does not identify who each severance payment is
made to).

 

You will note the Council’s decision to withhold this information is
subject to a current Ombudsman investigation. If this information is
released prior to the publication of the Annual Report, we will provide
you a copy.

 

You have the right to seek an investigation and review by the Ombudsman of
this decision. Information about how to make a complaint is available at
