Dear Government Services,

ACC's Official Information Requests Policy, part 4(b), states names of staff are considered official information which is information to be provided to the public through an OIA request. As such, section 9(2)(a) does not apply.

This policy specifically references the Ombudsman's guide titled "Names and contact details of public sector employees". In the Ombudsman's guide (and case numbers 486208 & 320402), the Ombudsman stated:
- section 9(2)(a) does not apply to names of government employees; and
- section 9(2)(a) does not apply to "health professionals.... their names should be made available on request for reasons of accountability."

All registered health providers names are published publicly by the relevant health authority. That is, the names of registered physicians are published by the Medical Council of NZ in their public registry, the names of registered nurses are published by the Nursing Council of NZ in their public registry, etc.). The public register is required by law. Thus, section 9(2) does not apply to health professionals.

Your grounds for refusal are inconsistent with ACC's policy, ACC's past actions, the Ombudsman's decisions on the matter, and legislation. As such, ACC's decision is to withhold this information is unreasonable, and thus a breach of section 54 of the AC act.

Please provide the information I requested, which should be made available according to ACC's policies, ACC's previous practices, the Ombudsman's decisions in similar matters, and the law.
