This request is for all information held by the Horowhenua Council and its agencies and advisors in relation to the communications between the Council officers, Councillors, Advisors and its consultants; and the owners of the land previously providing public access to the beach via the south end of Manga Pirau St, Waikawa Beach.
Can you provide all copies of internal and external meetings, phone calls, internal memos and emails including dates.
Can you also provide all copies of reports focused on reactivating beach access.
Can you also provide communication in relation to the construction of the fences ; including costs incurred by the Council.

Good afternoon Mr Muir
I refer to your request for information held about access to the beach at
Waikawa Beach. Your request in its current form is very broad and will
take staff extensive time to research and collate the information.
Typically, when processing requests such as yours, we are likely to
consider either proposing a charge or declining the request pursuant to
section 17(f) to the Act on the basis that the request requires
substantial collation or research.
We have completed a preliminary search with an open timeline which has
resulted in close to 23,000 emails. A search period from September
2022-September 2024 has resulted in approximately 3000 plus emails. This
search used a criteria of “Waikawa beach access” only. A search criteria
of Waikawa beach would capture many more emails. Additionally, this does
not include copies of internal and external meetings, phone calls or
internal memos.
As the current request stands, we estimate this at a minimum is 80 hours
of collation and potential redactions. The LGOIMA policy charges are $38
per half hour with the first hour free, therefore, an estimated total cost
of $6004.00 will apply.
In light of this, would you be willing to reconsider the scope of your
request to assist with making it more practically manageable to process?
Please note, any clarification of a request is considered to be a new
request for the purpose of calculating the maximum statutory timeframe for
response – see section 13(7) of the LGOIMA.

I can confirm that all your messages to the agency were handed over from our server to theirs (they did not "bounce"). I have also checked that the email address we are using matches the one given on the agency's website.
This means there is either a problem within the agency's email system, or they are ignoring your request. Problems with agencies' mail systems we have seen previously include:
* Their system deletes the message before it is delivered to the mailbox, and does not notify the recipient;
* Their system quarantines the message and no one is checking the quarantine;
* Their system delivers the mail but places it in a Spam or Junk Items folder, and no one is checking that folder.
The delivery confirmations for your initial request and follow-ups are below. These are the raw protocol messages that were generated by the agency's mail system confirming it accepted each message for delivery. These prove that the agency "received" the message in terms of the OIA.

I will try to contact the agency another way to draw their attention to the problem and let you know what happens.
While some agencies are responsive to this type of problem, sadly we have found others reluctant to investigate the problem (or ignore us completely) until there is an Ombudsman complaint.
