Dear Erica Stanford,
CFS-58303-Y5T8V1 - URGENT & IMPORTANT PLEASE RESPOND

How can leaders effectively govern a country for the betterment of its citizens, if they are unable to resolve even the smallest issues within a reasonable time frame and with a satisfactory resolution?

on January 19, 2024, while traveling from Colombo to Auckland, I encountered an unsettling situation. Prior to boarding my flight from Kuala Lumpur to Auckland, my New Zealand visit visa was inexplicably revoked by immigration authorities, leaving me without a valid justification.

This incident has not only damaged my credibility but also tarnished the reputation of New Zealand.

It has now been nine weeks since I initiated an appeal to senior officials in New Zealand to reinstate my visa, yet despite numerous reminders, I have received only a few replies, none of which have provided a satisfactory resolution to the unjust actions taken by immigration officer Norman McIver.

The silence from Hon Christopher Luxon, Prime Minister of New Zealand, Hon Erica Stanford, Minister of Immigration, and Ms. Carolyn Tremain, Chief Executive of the Ministry of Business, is deeply concerning and unacceptable.

Yours faithfully,

Kumara Edirisinghe

Kia ora Kumara,

Thank you for your email below in which you have intended to request the following information under the Official Information Act 1982 (the Act):

As we advised in our email to you of 10 April 2024, in response to a separate query, we are not satisfied you are able to make a request under the Act. As advised previously, section 12 of the Act states:

(1) Any person, being-
(a) a New Zealand citizen; or
(b) a permanent resident of New Zealand; or
(c) a person who is in New Zealand; or
(d) a body corporate which is incorporated in New Zealand; or
(e) a body corporate which is incorporated outside New Zealand but which has a place of business in New Zealand,
-
may request a department (for itself and for a departmental agency hosted by it or an interdepartmental executive board serviced by it) or interdepartmental venture or Minister of the Crown or organisation to make available to him or it any specified official information.

If you would like to make a request in accordance with section 12 of the Act, you will need to advise us which of the above criteria you meet to support a request. I note you responded to our email we sent yesterday, but you did not provide any information to suggest the above criteria were met to allow a request under the Act.

However, in good faith we would like to advise that even if your request was to be made in accordance with section 12, we consider it would have been necessary under section 18(g) of the Act to refuse your request. This is because we do not consider you have requested any information that is held by this office.

You are welcome to continue engaging with MBIE, as the responsible border agency, regarding your complaint. Information about how to make a complaint is available at:
https://www.immigration.govt.nz/about-us...

We also understand that you have an open complaint with the Ministry of Business, Innovation and Employment, which will be responded to in due course. You are welcome to quote the complaint reference number: CFS-60792-L2J8Z2

Kind regards,

Office of Hon Erica Stanford

Minister of Education
Minister of Immigration
