Regarding a qualification for an AEWV work visa enlisted by employers at ANZSCO levels

Dear Erica Stanford,

I would like clarification on the policy WA4.10.5(a) instructions. If an employer lists a relevant qualification for an AEWV work visa at a minimum ANZSCO skill level of 4, does the applicant need to have the exact qualification at that level, or would a higher qualification in the same field be acceptable?

For instance, if an employer requires a carpet cleaner to have either three years of experience or a relevant qualification at skill level 4 (Trade or Certificate), would a higher qualification at level 5 or above in the same field be considered suitable, assuming all other conditions in WA4.10.6(a)(i) and (ii) and WA4.12 English competency (IELTS band 4) are met?

Additionally, if someone holds a Bachelor’s degree, would it be deemed relevant under WA4.10.5(a)? This is particularly important since WA4.10.6(c) defines qualification as being relevant to any employment.

These instructions appear contradictory. WA4.10.5(a) states that if an employer requires a relevant qualification at a certain level, and WA4.10.6(ii) specifies a minimum qualification at level 4, a Bachelor’s degree satisfies the level 4 requirement, but may not meet the qualification requirement in WA4.10.5(a).

Therefore, the policy seems poorly articulated, with WA4.10.5(a) and WA4.10.6(a)(ii) and (c) being contradictory and misleading. Please clarify if a relevant higher qualification can meet the conditions, despite the employer advertising a lower qualification, and whether any Bachelor’s degree can be considered relevant for employment.

Given the high INZ fees, applicants want to avoid uncertainty, and clear guidance on these matters is essential for future job advertisements.
