Dear Kāinga Ora–Homes and Communities,

Under the Official Information Act, I request the following information:

1. What has been the cost to Kāinga Ora so far of legal fees associated with Winton Land’s lawsuit over their Sunfield development?

2. How many staff hours have been spent on the lawsuit? If you cannot provide an estimate please explain what actions have been undertaken to address the lawsuit and how many staff were involved?

3. Over the past five years how much has Kāinga Ora paid to Winton or its associated companies? And, what were these payments for?

4. Please provide copies of any reports, emails, briefings or other documents Kāinga Ora provided to Minister Bishop or his Office about the Winton lawsuit.

Yours faithfully,

Good afternoon
In relation to your request below, are you able to clarify in relation to
question 3:
“3. Over the past five years how much has Kāinga Ora paid to Winton or its
associated companies? And, what were these payments for?”
When you ask for information relating to “associated companies”, are you
referring to Winton Land Limited and Sunfield Developments Limited, who
are the plaintiffs in the litigation?

Of note, where requests are refined or amended, in accordance with section
15(1AA) of the Act, we will re-calculate the due date to allow us to
appropriately respond to the new information requested within 20 working
days. However, once we have received confirmation from yourself regarding
any proposed refinement, we will endeavour to respond to you as soon as
possible, to avoid undue delays with getting the information to you.

Many thanks
Monique

Good morning,

I am writing in relation to your request, copied below.

The Official Information Act 1982 requires that we advise you of our
decision on your request no later than 20 working days after the day we
received your request. Unfortunately it will not be possible to meet that
time limit and we are therefore writing to notify you of an extension of
the time to make our decision on this request, to 2 May 2024.

This extension is necessary because consultations necessary to make a
decision on the request are such that a proper response to the request
cannot reasonably be made within the original time limit.

You have the right to seek an investigation and review by the Ombudsman of
this decision. Information about how to make a complaint is available at
[1]www.ombudsman.parliament.nz or freephone 0800 802 602.

Many thanks
Monique
