Non-refundable costs paid to HMD

Dear KiwiRail,

I have three questions related to the contract and payments for the proposed two new Cook Strait ferries from Hyundai Mipo Dockyards (HMD), which is now being terminated.

1. Please inform me how much money has already been paid to Hyundai Mipo Dockyards (HMD) regarding the agreement(s) signed for the provision of two new Cook Strait ferries.

2. How much of the money paid will be refunded to Kiwirail as a result of the termination of the contract?

3. If that is yet to be finalised, what is the maximum that can be granted as a refund according to the contractual agreement which Kiwirail entered into with HMD?

Good morning Michael

 

Thank you for your enquiry, asking for information on:

 

1. Please inform me how much money has already been paid to Hyundai Mipo

the termination of the contract?

as a refund according to the contractual agreement which Kiwirail entered
into with HMD?

 

We are declining your request in full under 9(2)(i) – commercial
sensitivity and 9(2)(j) – commercial negotiations.

This is because we are still in negotiations with our international
suppliers to minimise costs as we work through the wind down of the iReX
project. 

 

Please be aware it is KiwiRail’s intention to proactively release as much
information related to Project iReX when we are able.
