Dear Auckland Council,
In regards to Unformed Legal Roadways, commonly referred to as "Paper Roads".
I understand it is in breach of the Land Transport Act, for any landowner to prohibit access to said roadways. After verifying some roadways with LINZ, and reporting these to the council for enforcement as access has been blocked by the landowner, commonly with padlocked gates, or entire fence-lines, there has been no enforcement conducted by the council. It appears at this stage, Auckland Council is failing to enforce breaches of the LTA, which restrict public access to public lands.
Based on this i would like to request the following.
1) Disclosure of the Auckland Council process for action on Unformed Legal Roadway enforcement and rectification. Process from beginning of identification of issue or complaint through to resolution, including SLA and typical resolution times.
2) Number of requests through Auckland Council (Including the properties team) for action/enforcement/correction of access to an Unformed Legal Roadway, recorded by year to date (As far as records allow)
3) Number of enforcement actions taken to restore access to Unformed Legal Roadways, and the road names this corresponds to.
4) If possible, the budget allocation against the ongoing enforcement and review of access to Unformed Legal Roadways (e.g inspections, call centre staff, admin staff, properties staff, enforcement team.)
