Thank you for your request, received on 9 December 2023, under the Official Information Act 1982 (the Act). The Electricity Authority responded to your request on 22 December 2023.

At the time of your request arrangements for a meeting with Hon Simeon Brown (Minister for Energy) were still to be confirmed. However, despite those arrangements only being finalised after the date of your request we decided, in the interests of efficiency for this request, to provide you with information that was created after your request was made.

Since responding to your request, we have discovered additional official information within the scope of your request. We apologise for omitting this information from our original response.

We have identified two staff communications on Microsoft Teams regarding the meeting on Monday 18 December 2023 at 6pm. These communications are attached to this email. Some information is being withheld under section 9(2)(a) of the Act to protect the privacy of natural persons.

On 22 December 2023 the Authority refused your request for notes taken at the meeting under section 18(e) on the basis that the document does not exist. However, we have since discovered that some notes were taken by an Authority staff member. These notes are being withheld under section 9(2)((g)(i) on the basis that there is a need to maintain the effective conduct of public affairs through the free and frank expression of opinions between Ministers of the Crown and Authority staff by ensuring that attendees at meetings are free to discuss matters openly without concern about the extent to which those discussions are recorded in notes which may be released publicly.

We are satisfied, in terms of section 9(1) of the Act, that the need to withhold the information referred to above is not outweighed by other considerations that render it desirable, in the public interest, to make the information available.
