It is not clear from your request how you identified these persons as
University of Auckland staff members. If you recognised them, please
supply their names so that I can contact them to action your request, or
otherwise provide any other information that would be helpful in
identifying the staff members you are referring to.

I refer to your request of 15 November 2023. As consultations necessary to
make a decision on your request are such that a response cannot reasonably
be given within the original time limit, the University has extended the
time limit for your request under section 15A(1)(b) of the OIA by 20
working days. The new maximum time limit for the University’s response is
1 February 2024; we will respond to your request as soon as reasonably
practicable. You have the right to make a complaint to an Ombudsman if you
are dissatisfied with this extension.

Dear Shane,

 

I refer to your request of 15 November 2023. The University’s response
follows.

 

“A number of University of Auckland staff were seated in the back row of
Courtroom 2.02 Federal Street, Auckland on the morning of November 6 2023.

I request a copy of all the handwritten notes taken by UoA staff that
morning in that courtroom.”

 

The University has identified three documents within the scope of your
request. The notes of two staff members were taken for the purpose of
obtaining legal advice, and have been withheld under section 9(2)(h) of
the OIA to maintain legal professional privilege. The notes of a third
staff member are attached as Attachment A. The University has redacted
personal information from page 1 of this document under section 9(2)(a) of
the OIA, to protect the privacy of natural persons. Some material on page
2 which does not relate to the court proceeding has also been redacted as
out of scope.

 

You have the right to make a complaint to an Ombudsman if you are
dissatisfied with this response.
