Dear Minister of Energy and Resources,
Section 38 of the Electricity Act 1992 provides that the Minister of Energy and Resources approve an electrical code of practice. Sub-section 38(2)(b) provides that the Minister shall not approve any aforementioned code unless the Minister has consulted such persons as will be affected by the aforementioned code or its amendment or revocation, or representatives of those persons, and they have had the opportunity to consider its possible effects and to comment on those effects to the Minister.
Can the Minister please tell me under the Official Information Act;
1. What consultation process was followed as required under Section 38 of the Electricity Act 1992?
2. If no consultation process was followed as required under Section 38 of the Electricity Act 1992, how and why was the Minister satisfied that sufficient consultation had already taken place?
2. What date was a notice published in the Gazette that the requirements of Section 38 of the Electricity Act 1992 had been complied with?
