2. TDC's anticipated time-frame for making final decisions on each item
in 1. above.
As above
3. TDC's anticipated time-frame for the delivery of each item in 1.
above.
As above
4. The proposed nature and timing of TDC's public consultation process
associated with 1. 2. and 3. above.
As above
5. Copies of all assessments of the impacts of the items listed in 1.
above on Golden Bay businesses held by TDC.
As above
6. Copies of all assessments of the impacts of the items listed in 1.
above on public health and safety held by TDC.
As above
7. Copies of all correspondence between TDC and NZ organisations and
their affiliates regarding "smart towns", "15 minute towns", "C40
Cities" and all similar concepts including, but not limited to, the NZ
Government, Local Government NZ, Local Government Funding Authority,
Smart Cities New Zealand, Sustainable Business Network, councils and
unitary authorities, universities, research institutions, think tanks,
industry associations, transport agencies and private sector
companies.
This request is refused on administrative grounds under section 17(g)
of the Local Government Official Information and Meetings Act 1987
(LGOIMA) because the information is not held by Council.
8. Copies of all correspondence between TDC international organisations
and their affiliates regarding "smart towns", "15 minute towns", "C40

United Nations, ICLEI (Local Governments for Sustainability), Smart
Cities Council, the World Bank, private sector companies,

similar events regarding development of the matters referred to above
that were attended by TDC staff, councillors and community board
members since 2018, including the number of each group that attended
them.
This part of your request is refused on administrative grounds under
section 17(f) of LGOIMA because the information requested cannot be
made available without substantial collation or research. For the
purpose of implementing these strategies, plans and policies there
have been numerous meetings and workshops held with our communities
and staff.
Where responses would involve substantial collation and research and are
to be refused on that basis, there is an obligation, under section 17(A)
of LGOIMA, to first consider whether raising a charge and/or extending the
statutory timeframe would assist in granting the request. In this
instance, neither would be appropriate because resources are not available
and diverting staff time to the production of this information would
unreasonably interfere with Council’s other operational business.
Furthermore, we do not believe there is a wider public interest or benefit
to Council’s operations to justify the work involved.
Similarly, with regard to question 1g, new housing developments, even in
its revised form, a response would require substantial collation and
research and so is also refused on administrative grounds (s.17(f)), with
the same considerations as above.
If you are not satisfied with Council’s response, you have the right to
seek an investigation and review by the Ombudsman. Information about how
to make a complaint is available at [3]www.ombudsman.parliament.nz or
freephone 0800 802 602.
If you wish to discuss this decision with us, in particular our response
to parts 1g and 9 above, please feel free to contact the Legal and
Democracy Services team on [4][email address].
Regards,
Legal Services Officer

Subject: Re: Clarification required - LGOIMA request - Transport, housing,
data collection and "smart town" plans for Golden Bay - Peter Russell -
Reference: 1494
Dear LGOIMA,
Thank you for your query regarding request 1g: Copies of all detailed
plans held by TDC regarding the proposed location and nature of new
housing developments in Golden Bay: "Can you please provide us with more
detail in regards to 1g, Are you requesting ALL new houses built in Golden
Bay? And, if so, for what time period?"
I require details regarding TDC's plans for the location (i.e. maps) and
nature (i.e. stipulations/restrictions regarding density, height etc.) of
all housing developments (i.e. new builds) in Golden Bay for whatever
future time-period such plans relate to.
Yours sincerely,
Peter Russell
