Official Information Act request, reference: GOV-016584

Paul White made this Official Information request to Accident Compensation Corporation

The request was partially successful.

From: Paul White

Dear Accident Compensation Corporation,

In the above mentioned OIA request, published on ACC’s web site, “https://www.acc.co.nz/assets/oia-respons...

I seek information in relation to the exemptions referred to in the following comments;

- “Recording and retention of phone calls.
ACC uses a recording platform to capture some calls and in doing so acts in accordance with the Privacy Act 2020 and the Public Records Act 2005. Calls to some departments are exempt from being recorded, including calls to the Sensitive claims department and Te Ara Tika”.

I can understand to a degree the exemption in relation to Sensitive claims, However I fail to understand that an exemption is given to Te Ara Tika unit. Its this information I request,

- why does Te Ara Tika get exempt from recording calls?, (when such exemption may disadvantage a client in challenging the accuracy of recorded comments or to not record any comments in the Contact notes)

I seek this information to help consider whether the exemptions may be in conflict with The Convention on the Rights of Persons with Disabilities

I am a NZ Citizen, a Permanent Resident and currently in NZ.

Yours faithfully,

Paul White

Can anyone explain what ACC's Te Ara Tika is? It certainly is not the same as the "Sensitive Claims" unit as implied by ACC's response.

Never, ever, rely on any NZ government agency recording the content of telephone calls you make to them. I bought a good quality Philips dictaphone recorder and used it during each and every conversation with the ACC. I never told them I was making a recording as they don't tell you when they're making their recordings. It turned out to be the best money I'd ever spent as irrrefutable evidence was able to be produced when ACC lied, blatantly, about what their employee had said.
