Resource Consent for Teitei Dr, Ohakune point 7.3

Response to this request is long overdue. By law Ruapehu District Council should have responded by now (details and exceptions). The requester can complain to the Ombudsman.

Dear Ruapehu District Council,

The AEE lodgement for resource consent of 46 lots on Teitei drive, point 7.3 lists and excludes adjacent properties to be excluded from the assessment In terms of the tests for public notification.

Excepting Council owned properties, and one Kainga Ora senior member working on the Teitei project and owning a property listed; all other property owners are against the project and have voiced concern.

I ask why this is the case considering The RDC Operative District Plan Policy RE2.2.2 states:
(a) To maintain and enhance residential character through Conditions guiding the density and development of Residential sites.

(b) To ensure any development exceeding these Conditions does not detract from the specific character of the area and does not adversely affect the residential amenity of adjoining or neighbouring properties.

1./ Why does the resource consent contradict the RDC Operative District Plan Policy RE2.2.2?
2./ Why were properties in point 7.3 of the resource consent being excluded
3./ Does RDC agree that RE2.2.2 is not being followed
4./ Does council believe it is fair to have excluded these adjacent properties & rate payers?
5./ Once council became aware that there was over 140+ residents in the Snowmass and surrounding streets against this project, did they consider putting the RC on hold, or pulling it?
6./ What discussions has council had since public zoom call 3rd Aug 2023 until 17th August. Please provide notes, txt messages, emails and any other form of note.
7./ Was council aware of the LGA consultation section 82 obligations regarding consultation on Teitei drive.
8./ Was council aware of the Policy of Significance requiring affected people be consulted?
9./ An article was published at https://www.stuff.co.nz/national/3009308... on 20th July, following this article, the Resource Consent was accepted on 25th July; who accepted the resource consent and were they aware of the rate payers concerns?
10./ Please provide the details of who accepted the RC (was it council) and did they believe the AEE had all the information correct and all policies had been followed?
11./ Why has council refused to respond to rate payers following the zoom call 3rd August, with all communications (even questions directed at Council) being forwarded to Kainga Ora for response.
12./ Does council believe they have acted in the best interest to rate payers with all the knowledge they have now
13./ Does Council believe they provided information that complied with the LGA section 82
14./ Does the council believe, provided all the information to date, it has breached any LGA acts with the Teitei project and if so which ones

Thanks for your response dated 12 October, to by questions asked 17th August (40 business days)

1./ The workshop held 16th August, Clive asked "What can we do to prevent legal action". What actions has been taken to date on this item, please provide any documents emails etc.

2./ The statement "Confidential project until Govt provided funded" seems a far cry, considering OIA documents show Teitei Drive has been in conception since at least August/November 2020, CIP funding did not require confidentiality, that only came about when Kāinga Ora was added to the mix. All other CIP funding projects were discussed in agendas, but not Teitei. Please provide the date that confidentiality was required from.

3./ It was clear of angst from both locals and "dual rate-payers" from the beginning. Please provide evidence of the statement "angst coming from second home buyers, not locals"

4./ The statement "Council not sold land as subject to resource consent", please provide evidence that council is allowed to sell land (when resource consent approved) without any consultation or following land disposal rules.

5./ The statement from Cr Hinch stated "Change the narrative and lead comms with Cr Hinch & Cr Wilson in the paper – invite group to a hui and give opportunity to have time with Council that is convenient for everyone". Please provide Cr Hinch actions to date that following this statement.

6./ On 8/08/2023 Clive forwarded the spacial plan, which shows Teitei as low density residential; if council was approving a private developers plan (like KO & RDC plan) would council still approve this? Happy to refraise; what does council consider low density residential and what District Plan rules & policies would they follow?

7./The email from Paul gave a copy of positive comments; and while we all share and agree, more housing is needed; what we disagree with is the consultation process, the secrecy and deception, the lack of asking rate payers to agree to the land sale. Please provide the attachments from David Cottage, which are likely the negative ones referred to.

8./ Like you have done for this OIA, Please provide any further documents, emails, text messages, notes, agendas, or any other form of communication or documentation from 17th August until 12th October (Today)

Sorry, one more followup...
Q9./ On 16th August, Clive states "Confidential project until Govt provided funded – only happened a few weeks ago". The agreement between Housing New Zealand Build and RDC was signed by RDC on 24 March 2023 and by KO on 4th April 2023. What agreements were signed after 4th April 2023 with regards to Teitei to backup Clives statement of being signed "weeks ago"?
