Thank you for your response.
For the record , I was born in NZ, a NZ Citizen and a current NZ Resident,
Firstly, over the past four years ACC has acknowledged over 12 OIA requests Ive made on fyi.org.nz, without the need for me to provide additional personal information, therefore ACC has set a precedence in satisfying their section 12 requirements, in addition I’ve also made OIA requests without issue from;
- NZ Police
- Hon Iain Lees-Galloway, Minister of Immigration, Minister for ACC and Minister for Workplace Relations and Safety
Due to the above history, I doubt the reason for the personal information is to prove I’am an NZ Citizen. I claim it’s to identify me in ACC’s database, including whether I have a current claim. The use of section 12 of the Official Information Act for this purpose would be unlawful, this would also be a breach of Principal 4 of the Privacy Act 2020.
ACC need to accept my history satisfies section 12 requirements by virtue of my FYI history of OIA requests with ACC, NZ Police and Hon Iain Lees-Galloway.
I believe the Ombudsman will find ACC’s position in the circumstances unreasonable when considering the above including my fyi.org.nz OIA history.
Please reconsider my OIA request as above or provide the with holding grounds in addition to your section 12 requirements, so I can refer this matter to the Ombudsman.
