I refer to your request of 9 January 2015 under the Official Information Act 1982 for information about people not enrolled for both the 2008 and 2014 elections.

 

Responses to each of your questions are set out below:

 

1.     In 2008 it was estimated that there were some 147,200 people not
enrolled to vote.  In 2014 this figure was 250,700 people.

 

2.     The estimated number of people not enrolled as a percentage of the
total estimated eligible voting age population for 2008, 2011 and 2014 was
4.7%, 6.3% and 2.4% respectively.

 

3.     There have been no prosecutions under s82(7)(a) of the Electoral
Act 1993.

 

4.     There have been no prosecutions under s82(7)(b) of the Electoral
Act 1993.

 

5.     Section 82(5) of the Electoral Act 1993 states that a person
commits an offence against this section who, being required by this
section to apply for registration as an elector during any period,
knowingly and wilfully fails to apply.  Under section 82(6) of the Act, a
person who applies for registration as an elector is not liable to
prosecution for his earlier failure to apply for registration as an
elector.  The Electoral Commission is not aware of any people who are
knowingly and wilfully failing to enrol.  Prosecution is expensive and
does not proceed in any case once an application is lodged.  The
Commission believes that effort should be focused on encouraging enrolment
and voting. 

 

6.     You have the right to complain to the Ombudsman if you are not
satisfied with the response to your request.

Please provide me with the following data for both the 2008 and 2014 elections;

 

1)     How many people were not enrolled, as prescribed by s82 of the Electoral Act 1993, on election day; and

 

2)     What is that number of unenrolled voters as a percentage of the population on that day. Please also include the 2011 percentage.

 

3)    How many of those were prosecuted under s82(7)(a); and

 

4)    How many were prosecuted under s82(7)(b); and

 

5)    Reasoning why, if any, people were not prosecuted?

 

If prosecution investigations are continuing for the 2014 election or there is an intention to prosecute in the near future, please provide me with the current data you have and a date when I can further request the completed data.

 

I am a New Zealand citizen, as required under s12(1) of the OIA Act 1982.
