2011 and 2014 Election prosecutions ss82 and 197

Dear New Zealand Police,

Could you please provide me with the following data from the 2011
General Election:

1) How many people were prosecuted under s82(7)(a) of the Electoral Act 1993; and
2) How many were prosecuted under s82(7)(b).
Could you also people provide any reasoning why, if any, were not
prosecuted?

3) How many complaints were received during the 2011 AND 2014 election campaign under s197 by individuals and how many refereed on by the Electoral Commission?
4) How many from 2011 were prosecuted?
5) Please provide a time-frame of when we can request data about the amount sent to prosecution for the 2014 election.

I am a New Zealand Citizen as required under s12(1) of the Official Information Act 1982.

Thank you for your email dated 6 October 2014 requesting the number of
prosecutions for Breaches of Electoral Act 1993 under sections 82 and 197.

 

Police record offences for Breaches of Electoral Act under one offence
code which is "7516 - Breaches Electoral Act". It records all breaches
under the act and does not distinguish which particular section of the act
is breached.

 

There were no prosecutions for "Breaches Electoral Act" that occurred
between 1 July 2009 to 30 June 2014.

 

Please note that the above information is publicly available on the
Statistics New Zealand website (www.stats.govt.nz).

 

I trust this information meets your needs. If you have any questions
please let me know.

 

Also, you have the right under section 28(3) of the OIA to seek a review
of my handling of your request by the Office of the Ombudsmen.

I have had trouble finding the above information on the website you provided earlier and request that you provide a direct link to the page you have referenced. It is my belief this information is not publicly available online, after conducting my own research.

Further, you could you please provide with the same data ("7516 - Breaches Electoral Act") for the period of 8 November 2008 through to the date of your response to this request (some date in February 2014).

I am a New Zealand citizen, as required under s12(1) of the OIA 1982.

I can confirm that the data is available on the Statistics New Zealand
website and I have attached a screenshot of the information you requested.
Should you have problems accessing it, please don't hesitate to contact me
on the details below and I will gladly assist.
 
Please note that Official Statistics for recorded offences and
apprehensions are produced three months after the end of each fiscal (30
June) or calendar (31 December) year. Therefore, statistics after 30 June
2014 are not yet available.
