Clarification around Piha Road closure.

Dear Auckland Council,

Hi,

The Auckland Emergency Management website states that the Piha Road is closed to non residents at the request of residents - "At the request of residents, Piha Road is closed to everyone other than residents and emergency services by a cordon at the junction with Lone Kauri Road. Security will be present."

Do the residents of Piha have the legal power to stop non-residents from coming to Piha? If so, what Act of Parliament or Council Bylaw grants them this power? What powers does Auckland Council have to stop people from visiting public places in a non-emergency situation?

Can you please release all correspondence with the residents who have requested that non-residents should not be allowed to go to Piha. Was there a specific vote taken or specific consultation with the Piha community in regards to this?

Thank you or your information request dated 2 April 2023, regarding Piha
Road closure.

 

In response to your request, I consulted with the council’s Response and
Recovery unit to provide relevant information. The specific details of
your request and our response is below.

Do the residents of Piha have the legal power to stop non-residents from
coming to Piha? If so, what Act of Parliament or Council Bylaw grants them
this power? What powers does Auckland Council have to stop people from
visiting public places in a non-emergency situation?

 

Piha residents do not have a legal power to stop non-residents from coming
to Piha. 

 

There is currently a national transition period in force for regions
including Auckland under the Civil Defence Emergency Management Act 2002
(the CDEM Act).  During a transition period, a Recovery Manager can
totally or partially restrict or prohibit public access to roads or public
places under the CDEM Act.  In addition, the Recovery Manager can exercise
powers under the Building Act 2004 in respect of buildings affected by an
emergency.

 

The decision to retain the cordon at Piha was made during the transition
period by the Deputy Recovery Manager, exercising powers under the CDEM
Act.  This was not a decision made by residents.

Can you please release all correspondence with the residents who have
requested that non-residents should not be allowed to go to Piha. Was
there a specific vote taken or specific consultation with the Piha
community in regards to this?

Members of Auckland Council, including the Acting Group Recovery Manager
and Deputy Recovery Manager, held community meetings with the residents of
Piha with the discussions included in decision making on continuing the
current cordons. There were no official minutes taken at these meetings.

 

Please note that on 3 May 2023, Auckland Emergency Management announced
the cordon restrictions into Piha will be lifted from this Friday 5 May,
allowing public access into Piha (with some restrictions remaining on
individual streets). Please refer to the following link for more details
