Requesting Road Camera Footage
kelly made this Official Information request to Hamilton City Council
This request has an unknown status. We're waiting for kelly to read recent responses and update the status.
      From: kelly

    Dear Hamilton City Council,
I would like to request to see road camera footage of the Galloway st/ Thermal Explorer highway Cobham drive double roundabout from the 15th of March 2023. I was going through the roundabout from Cambridge side, entering to turn right onto Galloway Street, on the inside lane of the roundabout when the car on the outer lane crossed over into my lane. Not knowing of the danger of cutting into the inside lane before exiting the roundabout. The car collided with my car as I tried to avoid the collision by moving slightly onto the edge of the roundabout.
The left front side of my car is damaged from the accident and I want to desperately claim insurance to repair, but I was not able to catch the car details from the driver because of heading in different directions exiting the roundabout and due to it being so busy at the time.
If I could anyway be able to retrieve the details of the car that hit me to contact for the insurance protocols for my car, that would be very very much appreciated.
I will be able to provide the date and time for the footage if it can be retrieved.
Yours faithfully,
kelly
        Hamilton City Council

 Kia ora,
Your information request
We write to acknowledge receipt of your information request about CCTV
Footage from Galloway St/ Thermal Explorer highway Cobham Drive double
roundabout on 15th of March 2023. Your information request has been
processed on 29/03/2023 and passed on to the relevant team within Council
for a response. The Local Government Official Information and Meetings Act
1987 (LGOIMA) requires that we advise you on whether Council will provide
the requested information as soon as reasonably practicable, and no later
than 20 working days after the day we receive your request.
We will respond to you no later than 28/04/2023 .
Urgent requests
If you have asked for your request to be processed urgently, the team will
try to meet the date you have specified. However it may not always be
possible to meet your timeframe due to staff resourcing, and the size and
 complexity of your request.
Fees & Charges
There is typically no charge, however the decision to chargewill be made
at Hamilton City Council's discretion and in alignment with our [2]LGOIMA
 Charging Policy.
If there is a charge to be applied, Hamilton City Council will notify you
 prior to incurring the charge.
Our management policy regarding charging is supported by theMinistry of
Justice Charging Guidelines for OIA requests.
You are entitled to three hours free and 20 pages of photocopying free of
charge. After that, charges of $38 per 30 minutes, and 20 cents per page
of photocopying applies. We may also recover any other actual costs, such
as special consultancy fees or other materials. This is set out in our
 Fees & Charges Schedule [3]here.
Pro-active release of information
One of the key purposes of LGOIMA is to make information more freely
available, which promotes good government and trust and confidence in
public services. Proactively releasing completed OIA requests that may be
of interest to the wider public can help reduce the need for individuals
to make requests for information and it can reduce the work for Council in
responding to requests. Before publishing information personal and other
identifying details are redacted. Generally, where a request relates to a
narrow topic, these requests won't be published. You can search previous
 published OIA responses [4]here.
COVID-19
There may be delays to OIA responses due to COVID-19 and other seasonal
illness impacting staff capacity both in the OIA team and across our
business. While we will aim to meet out statutory timeframes, a response
to your request may take longer than expected, or the timeframe for
responding to your request may be extended under LGOIMA.
Ombudsman
If you are unhappy with our response or our management of your information
request, you have the right to complain to the Office of the Ombudsman.
The Chief Ombudsman recommends contacting us in the first instance to see
if we can resolve the issue before a complaint is made. You can read more
about what help the Ombudsman can provide [5]here.

    Kia Ora,
I am writing to acknowledge receipt of your request below and request some
 further information.
Firstly, in order for us to release this kind of information, we would
require a complete Police Report with an accompanying police request for
the footage. Alternatively, and more commonly, you can have your Insurance
providers contact us for the footage. Please ensure that your Insurance
provides a release form, signed by yourself, for this information.
This is required to ensure the privacy of all parties involved is not
infringed upon. Our privacy policy states that CCTV footage will only be
viewed by authorised staff and representatives from public law enforcement
agencies (e.g. the NZ Police). This can be viewed [1]here.
Please note – CCTV footage is only held for a maximum of 30 days from the
date it was taken. In the meantime, we will send your request to the
appropriate team asking them to locate the footage. If the footage exists,
we will save a copy and preserve the footage until we hear from the Police
 or your insurance provider.
We will be in touch within 20 working days to advise you whether there was
any footage that was able to be retrieved.
Further Clarification
Secondly, as it currently stands your request for information is very
broad and covers a large time period which will involve substantial
collation. To help us identify the footage you have requested from 15th of
March 2023 can you please provide an estimated time period that the
incident occurred. We will then review the footage for this time period.
Can you please respond to the OIA team via this email address on the above
 by 05 April 2023.
I look forward to hearing from you.
Kind regards
