Police discretion when disqualified driver

I want to know police s.o.p on any discretion regarding a disqualified driver ie: a disq driver is pulled over in a deregistered vehicle, is the officer required to impound the vehicle and charge the driver, or can they let them go without penalty at their own discretion?
