Council refers to your request made under the Local Government Official
Information and Meetings Act 1987. Your request for information was
received by Council on  20/1/23.

 

Under Section 13 of the above Act, Council is required, as soon as
reasonably practical, and in no case later than 20 working days after the
date of which the request is received to:

 

(a)           Decide whether the request is to be granted and, if it is to
be granted, in what manner and for what charge (if any); and

 

(b)           Give or post to the person who made the request notice of
the decision on the request.

 

For your request, the 20 working days period has been calculated as being
no later than  21/2/23.  This due date takes into account 23/1/23
(Wellington Anniversary Day) & 6/2/23 (Waitangi Day).

 

Please note that Council is permitted to make a reasonable charge for the
cost of labour and materials involved in making the information available,
and for any costs incurred pursuant to a request to make the information
available urgently. If a charge is to be imposed, you will be advised
before your request is processed. 

 

Please also note that if Council declines your request in whole or part,
or if a charge is imposed for the supply of information, you have the
right to have the Council’s decision reviewed by the Office of the

during a meeting under the requirements of Local Authorities (Members'
Interests) Act 1968, any declaration made at meetings are within the

Decision to withhold some information requested

We have made redactions in the documents released to you. The reason for a
redaction is noted in the document and is explained below:

 

Privacy – physical address information redacted

Throughout the information release we have withheld the address of
properties owned by elected members or their immediate family members in
accordance with section 7(2)(a) of the Local Government Official
Information and Meetings Act 1987 (LGOIMA). Section 7(2)(a) of the LGOIMA
provides that there is a good reason for withholding official information
when the withholding of information is necessary to protect the privacy of
natural persons. The release of this information would disclose the
residential address and other property addresses of elected members and
their immediate family members which is not publicly available. We have
not redacted the area within Palmerston North of the property where stated
by the elected member on the form.  We have considered the public interest
in making this decision, however given the personal nature of the
information and that the information will be posted online through the FYI
website response, we do not consider that the public interest is
outweighed in this instance.

 

Privacy – school name redacted

There are instances in the bundle of documents where an elected member has
noted the name of local schools to which their children attend and their
association as a parent, we have withheld this information in accordance
with section 7(2)(a) of the LGOIMA. As noted above, this section allows
Council to withhold information where there is good reason to protect the
privacy of a person. The subject of this information is a minor who can be
linked to the elected member by their name, this being the case we have
decided that disclosure would breach their privacy as this information is
not publicly available. We have considered the public interest in making
this decision, however given the subject of the information is a minor,
would provide the name of the school they attend and that the information
will be posted online through the FYI website response, we do not consider
that the public interest is outweighed in this instance.
