Drink driving sentences per suburb

Dear Ministry of Justice,

I would like to request figures under the Official Information Act.

Of those convicted of drink driving in the Wellington region in the last two years, I would like to have their sentences broken down by the areas they live in.

Firstly I'd like statistics to be broken down into districts - Wellington, Lower Hutt, Upper Hutt, Porirua and Kapiti.

Secondly, in Wellington, I'd like the statistics to be broken down to individual suburbs.

Specific information I request is:
- The number of people from each area that exceeded breath or blood alcohol limits while driving in the last two years
- The number of people from each area that were convicted for low, medium and high range drink driving in the last two years
- The number of people in each area that were convicted for drink driving in the past two years that had been convicted for drink driving previously
- The average fine given to people in each area that were convicted for low, medium and high range drink driving in the last two years
- The biggest fine given to a person in each area that was convicted of low, medium and high range drink driving in the last two years
- The average number of hours of community service ordered to people from each area that were convicted for low, medium and high range drink driving in the last two years
- The highest number of hours of community service given to a person from each area that was convicted of low, medium and high range drink driving in the last two years
- The average number of hours of supervision ordered to people from each area that were convicted for low, medium and high range drink driving in the last two years
- The highest number of hours of supervision ordered to a person from each area that was convicted for low, medium and high range drink driving in the last two years
- The number of people from each area that were jailed for high range drink driving in the last two years
- The average length of jail terms given to people from each area who were imprisoned for drink driving in the last two years
- The longest jail term given to a person in each area who was imprisoned for drink driving in the last two years

To clarify - information relates to the area in which a person lives, not the area in which they were caught drink driving.

Classification of low, medium and high range drink driving should be taken from the definition used by police and/or other relevant authorities.

Thanks for your email.

We are unable to provide information about the particular suburbs that people convicted of offences live in. This is because their address forms part of the Court Record - i.e., it is judicial information - which is not available under the Official Information Act.

However, we can provide a breakdown for the Wellington area based on the court where the conviction was entered, which usually means the nearest court to where the offending took place. It is also important to note that the Upper Hutt and Lower Hutt District Courts were combined in March 2013 to form the Hutt Valley District Court. There is no breakdown of data available for Kapiti either as the nearest court is Porirua District Court.

Can you please advise if you want to continue with this request? Also given the significant compilation required and the consultation with police about their definitions of low, medium and high range drink driving limits, we may need to extend this request.

Thanks for your response. I have passed on your revised request to the team preparing the response.

As I indicated in my earlier email, due to the volume of information requested, a response cannot be made within the original time limit.

Accordingly, I am formally extending the time limit for response to this request for a further 20 working days under section 15A of the Official Information Act and will respond to you by 19 December 2014.
