I am following up on a request made earlier this year to ACC: OIA reference: GOV-018467.

Thank you for providing the total number of medical treatment injury or medical misadventure claims that were submitted to ACC between 1 July 2016 and 30 June 2021.

I am writing to request further detail. In particular, for each of the years 1 January 2016 to present, please provide the total of cancer and non-cancer related medical treatment injury or medical misadventure claims submitted to ACC which were related to care obtained at what is now known as Te Whatu Ora Health NZ Waikato (aka Waikato District Health Board) or one of their contracted providers (e.g., Hamilton Radiology, Midland MRI, Pathlab, etc.).

Dear Accident Compensation Corporation,

Thank you very much for your response dated Nov 9, 2022; however it did not include the information I had requested. You have only provided me with the number of claims which were submitted AND accepted by ACC. I am seeking the total number that was submitted to ACC, regardless of whether ACC accepted the claim or not.

I am surprised that you cannot differentiate between cancer and non-cancer related claims related to what was formerly known as Waikato DHB. The reason I am surprised by the response, is (1) the low number of claims that were accepted and (2) the fact that ACC had previously provided this information to a request that covered ALL of NZ rather than just the Waikato DHB region. This was about 6 months ago.

Would you please let me know when I should receive the information I had actually requested.

the response referred to in your request, GOV-018467. In our recent
response, GOV-021317, we have differentiated between accepted cancer and
non cancer-related claims for the Waikato DHB.
 
As outlined in GOV-018467, identification of cancer-related claims
involves a manual clinical review of individual claim details and is only
possible for accepted claims, where we have enough information on file to
determine whether the injury was cancer-related. Because of this, we were
only able to provide data on accepted claims for both responses.

Thank you for your follow up email related to a response received on 10
February 2023 (GOV-022857).

To better respond to your request, we would first like to clarify your
request. Can you please confirm if you would like data for submitted
treatment injury claims where the injury was cancer-related? 

If so, we note we are able to extract some information on the basis of the
Read or ICD codes recorded on the ACC45 claim form. The Read or ICD code
entered by a treating provider on the ACC45 claim form can
identify treatment injury claims submitted on the basis of a particular
condition. Please note this data is different from accepted cancer related
treatment injuries as a claim may not be found to be caused by treatment,
or failure to treat. The read code used may also not correctly describe
the injury caused by treatment. 

Extracting data this way would also not capture treatment injury claims
that had been submitted under section 48 of the AC Act. To extract this
data, we would have to manually review all submitted treatment injury
claims. Therefore, we are refusing this part of your request as it would
require substantial collation and research to extract. This decision is
made under section 18(f) of the Act. 

Please let us know by Friday 16 March if you would like to receive the
data, as outlined above, for submitted treatment injury claims. If we do
not hear from you by this date, we will proceed to make a decision on your
request as it stands.

This response still does not have the information I had requested.

Please provide the total number of treatment injury claims submitted to ACC for the dates I've request. The treatment injury claims do not need to be related to cancer. For instance, in 2022, ACC denied 8 of my treatment injury claims. These treatment injury claims were based on misdiagnosis and failure to treat non-cancer conditions, yet all 8 were denied. However, your table shows only 4 treatment injury claims were denied in 2022.

The internal policies require ACC to record the treatment injury and the evidence of an ACC45 form. An ACC45 form is a claim submitted under section 49 of the act (e.g., by a physician) where as there is no ACC45 form when the claim is submitted under section 48 of the act.

Given this information is captured in your system, there should be no reason for why ACC cannot provide a list based on those submitted under section 48 (by the claimant) vs those submitted under section 49 (by a physician using an ACC45 form).

Unfortunately, we are unable to identify the data in our system. This is
because we do not have a way to differentiate claims lodged under section
48 vs section 49 of the Accident Compensation Act 2001 (the AC Act).

As you note, claims lodged under section 48 of the AC Act have a different
method of lodgement. However, we do not capture this particular detail in
our claims data. The only way we could determine the number of such claims
is by manually reviewing all treatment injury claims lodged in the
relevant timeframe.

As such, we are refusing your request as it would require substantial
collation and research. This decision is made under section 18(f) of the
Official Information Act 1982.  
 
In doing so, we have considered extending the time limit for responding to
your request, or applying a charge (as allowed under the Act). However,
neither of these options has been offered as we determined that the
resources required to extract the data would unreasonably interfere with
the everyday functions of the teams involved.

Would it be easier for ACC to accept a OIA request based on specific keywords?
If ACC is denying they can differentiate between types of claims (which seems absurd considering it would need to use this data for reporting and prevention purposes), a search for claims using keywords 'Waikato' 'treatment injury' etc would surely be possible like in this OIA request?

I seek inforamton for each calendar year from 1 Jan 2016 to present.
This request is subdivided now into two categories.
Category (1) - Treatment Injury Claims related to Health NZ Waikato (formerly Waikato DHB) and their contracted service providers (e.g., Pathlab, Hamilton Radiology, Midland MRI, Midland PET-CT, etc.).
Category (2) - Treatment Injury Claims related to Health NZ (all NZ public hospitals except Waikato) and their contracted service providers (lab serv ices, radiology services, etc.)

For each of the two categories, there are four subcategories.
Subcategory (1): Treatment injury claims related to cancer.
Subcategory (2): Consequential injury claim related to cancer.
Subcategory (3): Treatment injury (TI) claims not related to cancer.
Subcategory (4): Consequential injury (CI) claims not related to cancer.

Request.
For each of the combinations of Category and Subcategory, I request:
(i) The total number of claims lodged with ACC; and
(ii) The total number of claims accepted by ACC; and
(iii) The total number of claims declined by ACC.

To check you have provided the correct information, for each year, each of the categories should have 12 number. Those 12 numbers, for each (Waikato vs all other public hospitals) would be:

 Thank you for your request below.
 Unfortunately, we are unable to identify the data in our system. This is
 because we do not have a way to differentiate claims lodged under section
 48 vs section 49 of the Accident Compensation Act 2001 (the AC Act).

 As you note, claims lodged under section 48 of the AC Act have a
different
 method of lodgement. However, we do not capture this particular detail in
 our claims data. The only way we could determine the number of such
claims
 is by manually reviewing all treatment injury claims lodged in the
 relevant timeframe.

 As such, we are refusing your request as it would require substantial
 collation and research. This decision is made under section 18(f) of the
 Official Information Act 1982.  
  
 In doing so, we have considered extending the time limit for responding
to
 your request, or applying a charge (as allowed under the Act). However,
 neither of these options has been offered as we determined that the
 resources required to extract the data would unreasonably interfere with
 the everyday functions of the teams involved.

To [1] above. Please provide me with the number of claim numbers allocated for each of the time periods in your answer to this request. All claims must be registered and allocated a claim number within 24 hours of claim lodgment.

For each of the time periods, please state the number of claims classified as a treatment injury claim which were allocated to the Treatment Injury Claims team and the number of treatment injury claims which were allocated to another team (e.g., Recovery Assisted Team). Claims that are new treatment injury claims, and not related to a another covered claim, must be allocated to the TIC team, whereas, consequential injuries related to an already covered claim, must be linked to the original claim and handled by a different team. You may want to phone the Hamilton Registration team to better understand this process.

Please provide a breakdown of TI claims by read code for Waikato DHB and Other DHBS, as well as the number accepted for that read code, and declined, based on the dates provided in your earlier response.
