Dear Requester

Thank you for your email of 23 September 2022 to Kâinga Ora, requesting information under the Official Information Act, 1982 (the Act).

We have established that the information you have requested is of commercial nature and we require you to kindly supply proof to one of the following eligibility criteria:

(a) a New Zealand citizen; or
(b) a permanent resident of New Zealand; or
(c) a person who is in New Zealand; or
(d) a body corporate which is incorporated in New Zealand; or
(e) a body corporate which is incorporated outside New Zealand but which has a place of business in New Zealand

Proof could include:
• NZ Drivers licence/ NZ Passport/Proof of valid visa; or
• Electricity/internet bill stating address in New Zealand; or
• Letterhead stating the name of the body corporate which is incorporated in New Zealand; or
• Letterhead stating body corporate which has a place of business in New Zealand.

The Ombudsman guidelines allows agencies to satisfy themselves as to the requester’s eligibility to make a request under the OIA. If a request is made by email or over the internet, agencies are entitled to ask reasonable questions to check whether the person is eligible to make a request.

Kindly respond back by COB 14 October 2022 for us to progress your request.

Kindly clarify what exactly is commercially sensitive in nature from the following.
1. Contracts awarded
2 . Nature of the awarded contract (open tender or directly appointed)
3. Sum of contracts
4. Any sub contractors working on the above contracts.

Clearly outline to us which of the above 4 items is commercially sensitive and why.

It is a standard request we have previously submitted to multiple other public agencies.

Should this not satisfactorily be answered, i will be forced to raise this matter with the ombudsman.

Dear Ninad Ingulkar,

The request us submitted as a LOGOIMA, and I would like to keep this confidential.

The document clearly states the following.

Many agencies consider this to be important information, but under the OIA the identity of the
requester is only strictly required for the purpose of establishing eligibility. (There are no
eligibility restrictions under the LGOIMA.2)

There is also no requirement for a person to give reasons for their request. Reasons can be
helpful in identifying the specific information sought, and in weighing competing public
interests in favour of withholding and disclosure. Agencies can ask a requester for their
reasons. However, requesters cannot be compelled to supply them, and should not be
pressured to do so.

Dear Requester

If you are referring to the LGOIMA - Local Government Official Information and Meetings Act 1987, then this does not apply to Crown/Central agencies.
The LGOIMA allows people to request official information held by local government agencies.

The types of agencies that come under the LGOIMA include:
1. city, district and regional councils;
2. council-controlled organisations;
3. local and community boards;
4. licensing trusts; and
5. airport authorities

The Official Information Act 1982 (OIA), applies to Ministers and central government agencies - such as Kāinga Ora - Homes and Communities.
