The "Arrest and Detention" chapter of the Police Manual, which clearly falls within the scope of your request, has been released previously under the OIA.

In full in November 2016:

There are differences between the full chapter released in 2016 and the excerpt released in July 2022, so it's possible changes have also been made to other parts of the chapter since it was last released in full.

NZ Police was legally obliged to respond to your request as soon as reasonably practicable, and no later than yesterday. I recommend you complain to the Ombudsman about this unlawful delay.

It's interesting that NZ Police took 5 working days longer than legally allowed in order to tell you that the information you have requested is publicly available on the NZ Police website... when it has been published there since you made your request.

The document in question was extracted from NZ Police's systems on 1 August 2022, one week after NZ Police received your request.

The NZ Police website only notes the month on which a page was published. However, based on my automated monitoring of the Police Manual chapters listing page on the NZ Police website, I believe this document was published there on either the 8th of 9th of August.

Therefore I believe it would clearly have been reasonably practicable for NZ Police to have responded to your request sooner. If you decide to complain to the Ombudsman, I would recommend you consider including this as one of the grounds of your complaint.
