LAWCOMM 403 Tax Law Exam Marks/Final Grades Delay

Dear University of Auckland,

On Monday 18 July, the faculty of law issued the following correspondence to LAWCOMM 403 students regarding the delay of exam marks/final grades: "We apologise for the delay in releasing the LAWCOMM 403 exam marks. Unfortunately these have been delayed due to circumstances outside of our control. We are endeavouring to release the marks as soon as practicable."

Unfortunately, the announcement provided little certainty in explaining the "circumstances outside of our control" or what "as soon as practicable" meant.

Please provide any internal correspondence and/or minutes related to the delay of the LAWCOMM 403 exam marks/final grades. This should include, but not be limited to, that which references the nature of the "circumstances outside of our control" and the anticipated date of mark/grade release.

Dear Greg,

 

I refer to your request of 23 July 2022. As consultations necessary to
make a decision on your request are such that a response cannot reasonably
be given within the original time limit, the University has extended the
time limit for your request until 2 September 2022 under section 15A(1)(b)
of the OIA. This is the new maximum time limit for the University’s
response; we will respond to your requests as soon as reasonably
practicable. You have the right to make a complaint an Ombudsman if you
are dissatisfied with this extension.

Dear Greg,

 

On 23 July 2022, you requested documents related to the delay of the
LAWCOMM 403 exam marks/final grades. You made particular reference to the
Faculty’s communication to students, which stated that the LAWCOMM 403
exam marks/final grades were delayed due to circumstances outside their
control, and that they were endeavouring to release the marks as soon as
possible.

 

Some of the information and documents within the scope of your request are
trivial, and so have been withheld under section 18(h) of the Official
Information Act. In accordance with section 16(1)(e) and 16(2)(c) of the
OIA, to avoid prejudice to the privacy interest protected by section
9(2)(a) of the OIA, the information requested from the other documents
requested has been provided in the form of a summary rather than as copies
of the documents themselves. The summary of this material is as follows:

 

 1. On 12 July, Law Faculty administrative staff were advised by the
examiner that they had been delayed in marking the LAWCOMM 403
examination due to illness.
 2. From 17-27 July, there is correspondence between Law Faculty
administrative staff and the examiner concerning marking the LAWCOMM
403 examination and communicating the delay to LAWCOMM 403 students.
 3. On 18 July, LAWCOMM 403 students were sent a notification about the
delay.
 4. The examiner completed the marking and prepared the results for the
assessor.
 5. On 26 July, due to the delay caused by staff illness and the enrolment
deadline for Semester 2 2022, arrangements were made by Law Faculty
administrative staff, and permission was sought and obtained from the
Dean of Law, for the examination marks to be assessed internally
rather than externally.

 

The LAWCOMM 403 marks/grades were released on 27 July 2022.

 

You have the right to make a complaint to an Ombudsman if you are
dissatisfied with this response.
