Thank you for your request on 9 April 2022 (below) where you asked for the 'NZ police brand manual'.

The document you have requested, 'NZ police brand manual', does not exist. Police has a series of documents (collectively referred to as ‘Police Instructions’) which details the instructions and guidance for administrative and operational aspects of policing in chapters including nationally consistent standard operating principles, practices, policies and procedures. A request for this document in its entirety would likely be refused pursuant to section 18 (f) of the OIA in that the information requested cannot be made available without substantial collation

To enable Police to respond, your original request will need to be clarified or amended. Could you please specify the topic area or areas you are interested in, so we can provide you with the relevant Police Manual chapters.

This is a confusing response. It sounds like NZ Police found the document you were looking for, arranged for it to be taken down, and then told you it doesn't exist?

Whether they consider it an "official New Zealand Police brand document" or not, Section 2(5) of the OIA is clear that:

"Any information held by an independent contractor engaged by any public service agency or Minister of the Crown or organisation in his capacity as such contractor shall, for the purposes of this Act, be deemed to be held by the public service agency or Minister of the Crown or organisation."

So if this document was created by this graphic designer while they were engaged as a contractor by NZ Police, then the OIA would consider it to be held by them and therefore their s18(e) refusal would not be justified.

However, there may be some complexity around whether or not this "design awards entry" work mentioned by NZ Police in their response to you would be sufficient for this graphic designer to have been considered "an independent contractor engaged by" NZ Police.

I recommend you consider laying a complaint with the Ombudsman so they can investigate this refusal and form an opinion.

Well, this request backfired, didn't managed to get the document and still got a awesome work down. It's really strange NZ Police doesn't use it, it's a good work.

I just noticed someone made a similiar to request, hope this one works.
