This is a request for information under the Official Information Act 1982. The response to this request may form in part a complaint to the Police Complaints Authority. As such, this request should be treated as urgent under Sec 12 (3)

For the period from 6pm May 10th 2014 to midday May 12th 2014, please provide the following:
For all persons arrested, detained, or otherwise held in custody within the confines of Palmerston North Central Police station:
Note: no information is required for those arrests or detentions which arrived at the station before the period stated.
1. The reason for their arrest, detention, or bringing into custody ( an offence code and or statute -Act/sect/ etc- )
2. The place of arrest, detention, or bringing into custody (streetname and suburb – no address required.)
3. The time of arrest, detention, or bringing into custody.
4. The arresting or detaining officer’s Identification ID number.
5. The time their detention within the confines of the station began according to station log/s
6. The main or primary charge, if any were laid (No details are required which might identify a victim, witness or suspect to an offence- however the specific details of which Act/Section/offence etc are required).
7. If not charged- then any infringement or fine or other mechanism served or given as notice of proceedings.
8. The time the detention ended according to station log/s.
9. If given- the reason the detention ended (ie; released without charge/ transferred to other facility/charged and released/died in custody/escaped etc)
10. The detained person’s gender and age in years (date of birth not required).

11. The total number of persons detained, arrested, or held in custody who are not included in the detailed listing, with a summary explanation.

The purpose of this OIA is to understand how police are using their powers of arrest and detention at PN Central station.

Good morning Mr O'Gorman,

Please find attached a scanned an signed letter from myself re you OIA request.

I have also attached a spreadsheet that contains the information that you have requested.

As discussed with you last week, I have taken out the names of the streets, as this may identify those persons who were arrested, but I have left the town from which they were arrested.

From out discussion last week, I understand that you wanted to know if there were prisoners arrested by the same Police Officer. I have taken out the officers numbers and replaced it with a 1, 2, or 3. Those numbers represent the arresting members, ie: Officer 1 made the arrests on row 1 and 11.

Thank you for the spreadsheet you prepared in response to my OIA.
Some points:
1. The reason for their arrest, detention, or bringing into custody ( an offence code and or statute -Act/sect/ etc- )
You have included the terms: INCIDENTS-INCIDENTS,TASKS-TASKS & A SERIES -ALCOHOL RELATED OFFENCES.
Can you please provide an offence code and or statute reference- as they stand they appear to be internal NZP references, rather than specific offences which could lead to a charge.

4. The arresting or detaining officer’s Identification ID number.
While we agreed in our telephone conversation recently that ID numbers were not required, only unique identifiers (eg Officer 1,Officer 2,etc)- you have not provided any such identifier for 16 of the 25 detentions detailed. The result of this is that I cannot determine if it was Officer X making all 16 arrests, or 16 officers making one arrest each. Can you please complete these details- and I reiterate this is not an attempt to identify individual officers or detainees.

6. The main or primary charge, if any were laid (No details are required which might identify a victim, witness or suspect to an offence- however the specific details of which Act/Section/offence etc are required).
You have not provided this information- however you have included a column "No charges filed reason" detailing 16 [reasons. Can you please provide specific charges (ie Offence+Statute) for those detainess who were charged- or alternatively confirm that they were not charged. I had provided an example - "SOA 29 (1) (b) ". I assume you are familiar with this format- ie the actual charge or that which an officer of the Court would expect to be presented.
7. If not charged- then any infringement or fine or other mechanism served or given as notice of proceedings.
You have provided a column named "No Charges Filed Reason" with 16 [reasons] detailed. They include the following: pcw, Put in twice, PCW, BoB, WTA, - which I hope you can agree are meaningless without a meaning given.

9. If given- the reason the detention ended (ie; released without charge/ transferred to other facility/charged and released/died in custody/escaped etc)
While some of this information is contained within Item 7 above- you have not provided this column.
11. The total number of persons detained, arrested, or held in custody who are not included in the detailed listing.

I cannot see where you have provided this Item.

The purpose of the OIA was given as: "The purpose of this OIA is to determine the detention-to-charge ratio at PN Central station", and while this is by no means the only purpose- I think you'll agree that this cannot be done with the information provided.

Nathan would you please consider completing the information with the work already done- rather than creating more work through more OIA requests.

Dear Nathan,
Thank you for the spreadsheet you prepared in response to my OIA.
Some points:
1. The reason for their arrest, detention, or bringing into custody ( an offence code and or statute -Act/sect/ etc- )
You have included the terms: INCIDENTS-INCIDENTS,TASKS-TASKS & A SERIES -ALCOHOL RELATED OFFENCES.
Can you please provide an offence code and or statute reference- as they stand they appear to be internal NZP references, rather than specific offences which could lead to a charge.

4. The arresting or detaining officer’s Identification ID number.
While we agreed in our telephone conversation recently that ID numbers were not required, only unique identifiers (eg Officer 1,Officer 2,etc)- you have not provided any such identifier for 16 of the 25 detentions detailed. The result of this is that I cannot determine if it was Officer X making all 16 arrests, or 16 officers making one arrest each. Can you please complete these details- and I reiterate this is not an attempt to identify individual officers or detainees.

6. The main or primary charge, if any were laid (No details are required which might identify a victim, witness or suspect to an offence- however the specific details of which Act/Section/offence etc are required).
You have not provided this information- however you have included a column "No charges filed reason" detailing 16 [reasons. Can you please provide specific charges (ie Offence+Statute) for those detainess who were charged- or alternatively confirm that they were not charged. I had provided an example - "SOA 29 (1) (b) ". I assume you are familiar with this format- ie the actual charge or that which an officer of the Court would expect to be presented.
7. If not charged- then any infringement or fine or other mechanism served or given as notice of proceedings.
You have provided a column named "No Charges Filed Reason" with 16 [reasons] detailed. They include the following: pcw, Put in twice, PCW, BoB, WTA, - which I hope you can agree are meaningless without a meaning given.

9. If given- the reason the detention ended (ie; released without charge/ transferred to other facility/charged and released/died in custody/escaped etc)
While some of this information is contained within Item 7 above- you have not provided this column.
11. The total number of persons detained, arrested, or held in custody who are not included in the detailed listing.

I cannot see where you have provided this Item.

The purpose of the OIA was given as: "The purpose of this OIA is to determine the detention-to-charge ratio at PN Central station", and while this is by no means the only purpose- I think you'll agree that this cannot be done with the information provided.

Nathan would you please consider completing the information with the work already done- rather than creating more work through more OIA requests.

I am sorry that you have had to chase me up on this.

I was positive that I sent you an email, asking to send me another OIA request, as the advice that I got was that I was to ask you to send another request, and I would respond to that. I was half way through my reply to you today, and I thought I better check my out box and I couldn’t find that email, clearly as I hadn’t sent it.

I have advised my supervisor of this (my) mistake and have been instructed to send you the prepared table that I have attached to this email.

Should you have any questions, please don’t hesitate to call me.

To explain the document, I offer the following.

1. Prisoners name taken out
2. Location of arrest, as discussed previously, I have shown the town as opposed to the street location, as that might identify people involved
3. Reason for their arrest or detention as to why they came through the cells. Police codes: A518 is excess breath alcohol, 7945 Breach of Release conditions
4. date and time that they were arrested
5. arresting members identity or QID (badge number) removed. I have numbered them, you can see that Officer 10 for example has arrested two people at the bottom of the first page
6. time that the prisoner or person in custody entered the cell block area
7. Their movement (ie: taken to district Court) charges laid, released without charge.
8. the time and date that they were released from Police custody. All of those with a date of 12.05.14 are people who were taken to Palmerston North District Court.
9. gender of arrested person.
10. age of arrested person.
