I am making an OIA request for a spreadsheet or document containing confirmed grades of across all students in the papers LAWS455 and LAWS462 for 2021. This need not contain further data other than their overall grades. I am asking for the specific grade percentage, not merely the grade letter. I can confirm I am currently in New Zealand as per section 12(1)(c) of the Act.

I refer to your information request dated 23 December 2021 made under the Official Information Act 1982. You have requested grade breakdowns of the 2021 LAWS455 and LAWS462 papers.

Please see attached a spreadsheet that shows the information you have requested.

For privacy and student wellbeing reasons, the University's standard practice is not to report on marks which related to 5 students. Where the numbers are very low, there is a risk that the identity of these students could be determined/inferred, and that their personal information (i.e. their grades) could be revealed. We therefore withhold this information pursuant to section 9(2)(a) of the Act, and we do not consider that the reasons for withholding this information is outweighed by other considerations which would make it desirable in the public interest to make the information available.

We also note that for each paper we have withheld the highest passing mark and the lowest failing mark. Revealing these marks would provide personal information about the highest passing mark and the lowest failing mark a student in the class could have achieved. Additionally, where the grade is Fail D or Fail E, if there are less than 5 students, we have indicated this using <5.

We trust that this information will be helpful.

We note your right to seek a review of these decisions via a complaint to an Ombudsman. However, we would welcome the opportunity to discuss any concerns with you first.
