You have not only failed to respond promptly to my request (for a copy of a document) but have also exceeded the limit of 20 working days.
Your statutory duty is set down in s13 (1) of the LGMOIA 1987:
"Subject to this Act, the local authority to which a request is made in accordance with section 10, or is transferred in accordance with section 12 of this Act or section 14 of the Official Information Act 1982, shall, as soon as reasonably practicable, and in no case later than 20 working days after the day on which the request is received by that local authority,—
(a) decide whether the request is to be granted and, if it is to be granted, in what manner and for what charge (if any); and
(b) give or post to the person who made the request notice of the decision on the request."

Hi Jack,
I refer to your request for the tender amendment for the Himatangi Beach
Sewerage Scheme.
Tender documents were issued to prequalified bidders. During the tender
process Notice to Tenderers were issued to clarify particular issues
within the tender documents. Are these the documents you are referring to?
If not please could you clarify what information you are seeking.

I did indeed mean “amendment” and not “clarification”.
I refer you to the council’s response to my OIA request concerning increased costs (request dated 28 August 2013; response dated 27 September 2013):
“In November 2011 Design and Build tenders were issued to five consortia who had been pre-selected from an Expression of Interest process. Three tenders were received from the Hawkins Infrastructure, Brian Perry and Blackley Construction lead consortia ranging in price between $8,112,683 and $9,576,091 (excl GST).
The three tenderers were then asked to submit revised tenders based on cost saving proposals outlined in their tenders. Two revised tenders were received and following this a contract was let to Hawkins Infrastructure lead consortia for the on lot works, reticulation and the construction of a wastewater treatment pond based on a design by MDC but excluding the process equipment which was to be supplied by others.”
I surmise that the amendment to the original “Design and Build tenders” must take the form of a specification of the changes to the original tender document - that is, it will include a clause such as “This Amendment Document shall now be considered as an integral part of the Tender.”

Subject: C4-1201 HBCSS Revised Scope and Price Schedules for Tender
Please find attached revised Price Schedules, drawings and specifications
for the above contract to reflect the revised scope of works as listed
below:
1. The wastewater treatment facility will comprise a single pond
incorporating final effluent storage with floating wetlands. MDC will take
responsibility for the process design, all mechanical and electrical
procurement including associated civil works, commissioning and consent
compliance associated with the ponds. Therefore Separable Portion E no
longer applies. The sand for the construction of the pond will be
available at no charge to the Contractor from the location shown on LEIL
drg no 10040-107 but Tenderers should allow for mining, transporting,
stockpiling and placing the sand as well as reinstatement of the mined
areas with topsoil and grass. MDC will be responsible for obtaining any
resource consents.
2. The proposed access track from Himatangi Beach Road and the
bridge over the stream have been deleted. Access to the WWTP site will now
be via the existing access off Lake Road. It is proposed to realign this
access route in part and upgrade it to provide a 3.5m wide metalled track
from Lake Road to the WWTP entrance.

You are requested to provide new rates/lump sums for those items where the
scope has changed i.e. Separable Portion A and Separable Portion B Parts
2.1 and 2.3 but should retain the rates submitted with your original
tender for Separable Portion B Part 2 and Separable Portions C and D where
the scope has not changed. To assist you with pricing I also attach a
preliminary schedule of quantities but this is currently being checked by
CPG. I will issue a final schedule on completion of their check.
You may also provide alternative rates for any other proposed cost
saving measures in addition to your original tender rates.
Revised Price Schedules and supporting information need to received
by email not later than 9am and 2 hard copies not later than 4pm on
Tuesday 10 April. Tenders are to remain open until 31 May 2012.

Thank you for the information supplied so far.
However some further documentation is needed in order to fully specify the amendments:
1. Your email to the tendering consortia (“Subject: C4-1201 HBCSS Revised Scope and Price Schedules for Tender”, 28 March 2012) does not mention the change from a specified one pump unit per property to a default of one pump unit shared between two properties. I refer you to your “HBCSS Update” to residents of 21 December 2011: “.... For the Himatangi Beach Community it is proposed to put a wastewater pumping unit on each property ....”; and also to your “HBCSS Update” to residents of 26 April 2012: “..... During the tender process savings in excess of $1,200,000 were identified by allowing two properties to drain to a single PSU. ...”. Could you supply please the full documentation for this amendment.
2. Could you supply please the original 6.1 Separable Portion E - Operational Supervision and Performance Proving Period.
3. Could you supply please documentation for any other amendments not otherwise provided for (- not restricted to Section 6 “The Schedules").
It seems to me that the best way to satisfy the above would be to provide the original and the revised tender each in its entirety.

Good Morning Jack,
1. The proposal to connect to two properties to one pump station unit was put forward as an alternative tender by the Hawkins Infrastructure consortium with their revised tender. It was not a Council specified requirement and therefore was not included in the revised tender documentation. Council decided to accept the alternative tender because of the savings which would accrue if it was accepted.
2. The original tender document is enclosed as requested which includes the Separable Portion E schedule.
3. The revisions to the original tender document are covered by the revised tender requirements which were forwarded to you last week.
