Dear Mr Kettlety

 

Further to my initial response to your request for information under the
Official Information Act 1982, when I sought further evidence of your
assertion that you are a permanent resident of New Zealand, Police are now
satisfied as to your eligibility to make this request pursuant to section
12 of the Act. 

 

Your request dated 9 June 2014 was for “the first name and surname of
officer number: NWJ012 based in the Hamilton Highway Patrol Unit”.   On 10
June, you also requested “the length of service the aforementioned officer
has had with the Hamilton Highway Patrol Unit”.

 

Police are willing to disclose to you the information requested, by
furnishing the information:

 

·         orally, or

·         in writing to a private physical or email address 

 

I ask that you provide to me the following information, at your earliest
opportunity:

 

·         your contact phone numbers and or,

·         your private email address and or,

·         your physical address

 

The reason is that the information requested is personal information and
the FYI website used by you to make this request states that Police’s
reply will be published. Police considers that any public interest in
providing you with the name and length of service of the officer, weighed
against the officer’s privacy, is met by private disclosure to you.

 

For your information on Police’s position regarding checking for
eligibility, section 12 of the Official Information Act sets out who is
eligible to make a request under the Act.  An agency subject to the Act is
entitled to check whether a person is eligible, especially where the
request involves sensitive information, or personal information about a
third person, or will cause a large drain on resources; in order to ensure
that the Act applies including the ‘good faith’ protection from civil or
criminal proceedings (section 48).   

 

Police may ask a requester who has asserted their eligibility to provide
supporting information, such as a New Zealand postal address, personal
email address indicating a NZ domain, NZ phone number on which they can be
contacted, or any identity documentation. Further information can be
provided to Police by post, email or phone. 

 

Police’s position is based on the following guidance provided by the
Ombudsman:

 

With requests submitted by post, the origin of the request will usually be
clear from the post mark, and the requester will normally provide a return
address, which should together provide sufficient assurance that the
requester is in New Zealand, and therefore eligible.

 

With requests submitted by email, twitter or Facebook, it may not be
apparent that the requester satisfies the eligibility requirements under
the OIA.

 

Agencies are entitled to make reasonable enquiries to satisfy themselves
that a requester is eligible to make an OIA request. Often provision of a
New Zealand postal address will suffice. This information can be conveyed,
if requested, via personal message. The working day count won’t start
until it is clear that the request is made by a person who is eligible to
do so.

 

Agencies must be mindful of their obligation to provide reasonable
assistance to a person who wants to make an official information request,
but hasn’t made one in compliance with the legislation.

You stated you are a permanent resident of New Zealand.  I was not
satisfied of your eligibility and sought further details by suggesting
that completion of the standard Police request form would provide
sufficient evidence of your eligibility. 

 

Police acknowledges that the form provides for more detail than may be
necessary for a request via email and you would not have to complete it in
full to provide assurance of eligibility. 

 

Since your response declining to complete the form, Police has been able
to confirm your eligibility from its own records.

 

If you are not satisfied with my response to your request, you have the
right to complain to the Office of the Ombudsmen and seek an investigation
and review of my decision.
