Dear Ministry of Health,
What legal framework is in place to support the mandate of medical procedures under the threat and/or the loss of employment?
What legal framework is in place to support the public publishing of medical records and status under the threat to limit access to public spaces, travel freely or associate with communities?
What legal framework is in place to support the discrimination of persons who have not undertaken "mandated" or "specified " medical procedures or treatments?
I know these are dire times, but some freedoms should be untouchable.

As required under the Official Information Act 1982, the Ministry will
endeavour to respond to your request no later than 9 November 2021, being

Response to your request for official information
Thank you for your request under the Official Information Act 1982 (the
Act) to the Ministry of Health (the Ministry) on 11 October for:
“What legal framework is in place to support the mandate of medical
procedures under the threat and/or the loss of employment?
What legal framework is in place to support the public publishing of
medical records and status under the threat to limit access to public
spaces, travel freely or associate with communities?
What legal framework is in place to support the discrimination of persons
who have not undertaken "mandated" or "specified " medical procedures or
treatments?”
Orders made under the COVID-19 Public Health Response Act 2020 (the Act),
such as the COVID-19 Public Health Response (Required Testing) Order 2020
and COVID-19 Public Health Response (Vaccinations) Order 2021, set out
requirements for requirements such as mandatory testing and vaccination.
Requirements for COVID-19 Vaccine Certificates will also be mandated by
order under the Act. Copies of these orders are available at the following

Orders are made with regard to public health advice and ensuring that it
is justified in light of the public health risks and in accordance with
the New Zealand Bill of Rights Act 1990 and Human Rights Act 1993. How
this is undertaken is illustrated in this recent High Court decision
relating to a challenge to the Vaccinations
