(‘Council’), received 28 January 2021. This was referred to Legal Services
for consideration, in accordance with the provisions of the Local
Government Official Information and Meetings Act 1987 (the ‘LGOIMA’).
Information request
You requested as follows:
1. “Could you provide a list of roads in the Far North district that FNDC
has received the most complaints about. If this is too much work for
an OIA request then a top ten list would be acceptable.”
2. “Could you also list any metal roads that are scheduled or planned
for in the future by Council to be sealed regardless of funding or
not.”
Council response
Pursuant to the LGOIMA, please find attached:
1. A list of the 15 roads in the Far North District that Council has
received the most complaints about ( i.e. requests for sealing / dust
sealing) in the last 12 months.
2. A list of all the road sections (i.e. Treatment Lengths) that Council
has “scheduled or planned for in the future by Council to be sealed
regardless of funding or not“, as at end of 2020. The list is
presented in alphabetical order. It is important to note that these
rankings are never absolute given they are subject to continual change
as-and-when new/updated data becomes available. The Dust
Prioritisation Tool Matrix (Roading Matrix) contains more than 1,840
sites with 22 measures, so it comprises in excess of 40,500 dynamic
data records - which constantly shift the order of prioritisation.
Therefore the list attached only shows a prioritisation snapshot at a
certain point in time (as at the end of 2020). You may further find
it helpful to read the FAQ Pamphlet (also attached) which provides our
customers with the details relating to the various criteria used in
the Roading Matrix etc.

(‘Council’), received 24 March 2021. This was referred to Legal Services
for consideration, in accordance with the provisions of the Local
Government Official Information and Meetings Act 1987 (the ‘LGOIMA’).
Information request
You asked “Can you please provide me with the $ amount of rates collected
from the Russell Peninsula - the latest information available".
Council response
Council has considered your request and decided that unfortunately, it
lacks sufficient clarity to enable Council to provide you with any
meaningful response. As you may be aware, a requester of official
information is obliged to be as specific as they can be. Section 10(2) of
the LGOIMA requires that for a request to be a valid, the information
sought must be ‘specified with due particularity’. This means that Council
must be reasonably able to identify what information is being sought.
The area ‘Russell Peninsula’ is not defined at all; and therefore there is
insufficient detail for Council to be able to properly determine the scope
of your request and exactly what information you are seeking - in order to
provide you with a full and accurate decision/response. As it stands,
Council does not consider this to be a legitimate request and so the
requirements of the LGOIMA do not apply.
Council has decided that under section 10(2) of the LGOIMA, it is unable
to grant your request. However, if you wish to submit a fresh LGOIMA
request, duly particularised (including clearly identifying the area of
Russell Peninsula), then Council would be happy to look at it.
You have the right to seek a review by the Ombudsman of this decision
should you wish. Information about how to make a complaint is available at
[2]www.ombudsman.parliament.nz or Freephone 0800 802 602.
