Dear Julie,
On behalf of the Ministry of Business, Innovation and Employment I
acknowledge your email of 7^th December 2020, transferred by Accident
Compensation Corporation on 18^th December 2020, requesting under the
Official Information Act 1982 (the Act), the following:
“Please could you send me the information that you have relating to the
reasons and justification for excluding commercially sponsored clinical
trials from ACC cover. In particular, the decision that resulted in the
removal of cover for all trials from the ACC act.”
Please note that the days from 24 December 2020 to 17 January 2021
(inclusive) are defined as non- working days in the Act and are not
counted in the calculation for the response due date. This will affect the
time period for responding to your request.
Your request is being processed in accordance with the Act and a response
will be sent to you in due course.
Please note, due to ongoing COVID-19 response work, requests are currently
being triaged and those relating to Covid-19 processed as a priority.
Remaining requests are being assessed as per the Ombudsman’s guidance

Thank you for your response.
In the response letter that you sent me, you said:
"We are able to provide the relevant page (page 45) from the Department of Labour’s Departmental Report in 2001 on the Injury Prevention and Rehabilitation Bill, which became the Injury Prevention and Rehabilitation Act 2001 and was renamed the AC Act in 2010. Page 45 provides the Department of Labour’s commentary on the rationale for continuing the exclusion of cover for injuries resulting from a commercial clinical trial. "
The page doesn't appear to be appended along with the other documents. Could you please forward this page if you also find it has not been included.
Also, the phone number that was provided with the response has an automatic message that says 'the person you are trying to reach, does not have a valid voice mailbox on our system, goodbye'. It doesn't ring, just goes to the message. Is there a better number that can be provided?
