Request for access to information held by Netsafe
Thank you for your correspondence of August 24, 2020 where you requested:
1. Information on whether [Netsafe has], or know that some government
agency has, ever blocked the website tutanota.com
2. Any blocklists that [Netsafe] use, or advocate to telecoms or any
Government agency to use, to restrict access to websites by NZ users.
3. How many websites are blocked by [Netsafe], or are blocked on advice
given by [Netsafe], in the New Zealand jurisdiction.
Netsafe will consider and respond to your request in accordance with the
Official Information Act 1982. The Act allows up to 20 working days for a
response, making September 21, 2020 the latest date for our response to
you, unless an extension is required.

Dear Rich,
Official Information Act (OIA) request for information held by Netsafe.
I refer to your OIA request dated August 24, 2020.
The OIA requires that we advise you of our decision on your request no
later than 20 working days after the day we received your request.
Unfortunately, it will not be possible to meet that time limit and we are
therefore writing to notify you of an extension of the time to make our
decision, to October 5, 2020.
This extension is necessary because your request necessitates a search
through a large quantity of information and meeting the original time
limit would unreasonably interfere with our operations at this time.
You have the right to seek an investigation and review by the Ombudsman of
this decision.

We have considered your request in accordance with the Official
Information Act 1982 and Netsafe’s Privacy and Information Statement. We
have included below the information you requested.
1. Netsafe has not blocked the [3]tutanota.com website at any time. We
have not received communication from other government agencies outlining
that they have blocked the [4]tutanota.com website.
2. Netsafe does not use any blocklists or advocate to any
telecommunication companies or government agencies the use of blocklists
to restrict or prohibit access to any websites by New Zealand internet
users.
3. Netsafe does not block websites. However, where Netsafe has been made
aware of content, hosted on websites, that is likely to be objectionable,
as defined in the Films, Videos and Publications Classification Act 1993,
we pass this information to the Department of Internal Affairs (DIA). The
DIA does not report to Netsafe if websites are blocked.
You have the right under section 28(3) of the OIA to seek an investigation
and review by the Ombudsman of our decision which relates to your OIA
request.
