On 3 July 2020, you emailed the Ministry of Social Development (the Ministry) requesting, under the Official Information Act 1982 (the Act), the following information:

"Please provide copies of all Memorandum Of Understanding (MOU’s) signed in the last five years related to the sharing of data to organisations outside your organisation."

To determine whether MSD can satisfy your request within the usual statutory timeframe, we need to better understand the nature and scope of your request.

In terms of scope, there are two components we seek to better understand.

Firstly, we need to clarify what organisation means. Are you seeking MoU’s that MSD has with other core government agencies, or are you seeking any MoU that MSD has with any organisation that MSD has a statutory or contractual arrangement with, for example, an MoU with an organisation providing employment services on behalf of MSD. If your request includes the latter, this may encompass many hundreds or more agreements - such a request might not be able to be satisfied as it may require substantial collation or research.

Secondly, we need to understand the rationale for the time period of 5 years. Is the period of significance or would a lesser period still fulfil your needs? The larger the period, the more expansive your request which will have an effect on our ability to reasonable met your request in the allowable timeframe.

We also highlight to you that in most circumstances, MSD will be required to consult with the other organisation that is party to the MOU before releasing any material. As such, a more targeted request will mean we will be more likely to satisfy your request within normal timeframes without requiring an extended period of time.

Please respond as soon as practicable so that we can start work on meeting your request.

Please note that once you have amended or clarified your request, under section 15(1AA) of the Official Information Act, the Ministry may treat your amended or clarified request as a new request that replaces the original request. This may lead to a new start of the statutory response period.

On 8 July 2020, you clarified your request with the Ministry, and it was
refined to a request for the following information:

 

o Copies of all currently active Memorandum of Understanding (MOU's)
between the Ministry of Social Development and core Government
agencies relating to the sharing of data between Government agencies,
signed with the last five years

 

On 4 August 2020, the Ministry advised you of the need to extend the time
available to make a decision on your request until 5 November 2020.

 

The Ministry has decided to grant your request. However, it will take some
more time to prepare the information for release. You will be provided
with 17 documents, which will be sent to you by 3 December 2020, earlier
if possible. These documents will be partially released.

 

You will note that the names and contact details of some individuals will
be withheld under section 9(2)(a) of the Act in order to protect the
privacy of natural persons. The need to protect the privacy of these
individuals outweighs any public interest in this information.

 

Some information will also be withheld under section 9(2)(k) of the Act to
prevent the use of disclosure of official information for improper gain or
improper advantage.

 

Furthermore, information will be withheld under section 6(c) of the Act as
making that information available would be likely to prejudice the
maintenance of the law, including the prevention, investigation and
detection of offences.

 

The Ministry has also made the decision to refuse aspects of your request
for documents which are already publicly available, under section 18(d) of
the Act.

 

If you wish to discuss this decision with us, please feel free to contact
