Thank you for your inquiry re: out of zone inquiry – fourth priority.

In answer to your question, under 11F(1)(d) of the Education Act 1989 (the
Act) fourth priority must be given to any applicant who is a child of a
former student of the school. Your question asks: does ‘child of a former
student of the school’ extend to a stepchild of a former student of the
school?

 

Yes it does if the step parent is a legal guardian of the child.

The Act defines what the word parent means: “parent, in relation to any
person, means a person who is the person’s mother, father, or guardian”.

So, the fourth priority would not apply if a step-parent is not a legal guardian?

ie. where only the biological mother and father are the legal guardians?
