I would like to request the following information under the Official Information Act (OIA).

1. Statistical information on the number of class 1 restricted & full license tests conducted and corresponding number of passes and failures for the period 01-Sep-2012 to 31-Aug-2013 grouped by:
(a) The type of license - restricted or full and
(b) The testing center and
(c) An anonymous (or pseudo) ID of a testing officer and
(d) The number of resits per candidate (e.g. 3 resits by 2000 applicants for restricted license) and
(e) The number of resit taken per candidate before obtaining the pursed type of license (e.g. 2000 people took 2 resits before obtaining restricted license) and
(f) The age of candidates (the ages and age bracket used by NZTA in its monthly publication of pass rates statistics would suffice) and
(g) The gender of candidates.

2. The quality control and/or audit procedures in place to ensure integrity and trustfulness of practical driver testing.

If the information in part 1 cannot be supplied in a statistical form, the summary records of each practical test in an anonymous format would suffice so I could compile the report needed. Following data is required for each test unless indicated otherwise:
(i) An unique candidate ID and
(ii) The date when the test was conducted & the type of test and
(iii) An unique testing center ID and/or name and
(iv)The birth year/age of the candidate (age bracket would suffice) and
(V) The gender of the candidate and
(vi) The result - pass / failed and
(vii) The type of failure (e.g. immediate or critical) if applicable and
(viii) An anonymous (pseudo) ID of the testing officer.
(ix) The overall score (optional).
(x) Comment of the testing officer (optional).

Thank you for your email of 30 September 2013 requesting under the
Official Information Act 1982, information about pass/fail rates of driver
licence tests.

 

In order to process your request, we ask that you clarify the following
question:

 

1. Statistical information on the number of class 1 restricted & full
license tests conducted and corresponding number of passes and failures
for the period 01-Sep-2012 to 31-Aug-2013

‘new driver licence’ application), or whether you would like to include
statistics of converted licences (people from overseas) and/or
requalification's (people getting their licence back after a suspension
etc).

Dear NZTA,

The information I require for part 1 (or it's alternate part) should only include data for all types of candidate so long as they have sit both or either of restricted/full license test. In case of overseas license conversion candidates, I understand that some of them are not required to sit restricted test (but do sit full test) which is fine because pass/fail data would be grouped by type of license before being down further. For candidates who are coming back from suspension, it's possible that they would have sit practical test(s) at a date outside of the data period I requested. In this case please include tests that fit inside the period I requested.

And for further clarification, the candidate age should be what he/she would be between the period of 1-Sep-2013 o 31-Aug-2013 (the data period).

Dear NZTA,

Thanks for responding to this request within the statutory time-frame.

Unfortunately, it appears that a key wording, "grouped by", of the request was misinterpreted. I understand that I many not have been quite explicit on the type of grouping. Please accept my apology.

I require the statistical data to be grouped in a tree like format. Such that data for one group (or point) adds up or accounts to points (or groups) above it. For example, the pass/fail data for point 1(c) should be broken down further in 1(d). In another words, there is a clear link between each group/point.

If you're unable to supply the requested data in this form then please provide me with anonymous test data as detailed in my first correspondence for the time period requested.

It's possible to construct a tree like statistics from the data you've provided for some points but not all.

If possible please provide this part of request in spreadsheet format, perhaps in addition to PDF.

Also please provide the following details regarding the paper audits of diver testing - how often they are conducted, by whom, any manual/procedure involved that can be made public without compromising the operational ability of the audit system. You may treat this part of request as a separate request.

Thank you for your email of 25 October 2013. Please accept our apologies
for the delay in responding.

 

After much thought and consideration, and on reviewing the dataset in the
tree like format as per your request, we must advise that the data (even
in its anonymised format) can not be provided.

 

The reasoning for this outcome is as follows:

 

1.         Although the data has been made anonymous, there is potential
for individuals or testing officers to be identified from the data because
of the sometimes small datasets

2.         The data may be used to make uninformed conclusions without
knowing the full context of the data

3.         We have provided summarised data to answer all the questions
asked. 

 

If, however, you are looking at finding trends in fail rates by testing
officer and site, we are more than happy to provide a summarised and
anonymised pass/fail rate for the testing officers for each site.

Thanks for your reply.

The data (anonymous or otherwise) I requested doesn't include any personally identifiable information such as name, contact details, driver license number. Any information should be made available under an OIA request (purpose of this act) so long as the information doesn't fall within a prohibited category of OIA act such as privacy. Therefore, I disagree that any individual candidate or testing officer can be identified.

To my knowledge, concerns of forming uninformed conclusions from information obtained under an OIA act is not a legal reason to refuse an OIA request.

You've provided summarised statistical data. I did not asked for such form of summarised data. This form of summarised data doesn't provide the information I initially requested as I've explained subsequently after the receipt of the summarised data. Therefore, I'd have to classify this request as denied if you're not able to provide the data in a tree like statistical format or in an anoynoumus form I detailed in my initial correspondence for this request.

If you're not absolutely sure of exact details of "tree like statistcal data" or would require substantial collation/research then please provide the data in the anoynoumus form. Please provide any such data in a spreadsheet if possible.

Please clearly state legal reason(s) with reference to section(s) of the relevant law that prevents you from providing tests data collated in either of the form I requested.

In my previous message, I've asked for detailed information regarding the paper audits of practical dirver testing. I stated that you may treat that part of the request for detailed information of paper audits as a separate request for the purpose OIA act since request for follow-up ifnormation would legally be a separate request. Please advicse me on the progress or status of this request.

Thank you for your email of 9 December 2013. Please accept our apologies
for the delay in responding.

 

Section 16 of the Official Information Act 1982 states, where the
information is not provided in the way preferred by the person requesting
it, the department or Minister of the Crown or organisation shall, subject
to section 10, give to that person— (a) the reason for not providing the
information in that way. Whilst you have requested the information in a
tree like form, we cannot action your request for the following reasons:

 

·         In accordance with Section 18(f) of the Act, the information
requested cannot be made available without substantial collation or
research. Additionally, we have provided the information in the form that
we have because making the information available to you in the way that
you prefer would 'prejudice the interests protected.

·         Section 9(2)(a) states the information has been provided in the
form that it has in order to ‘protect the privacy of natural persons’.

 

You have again asked for information on paper audits. Previously, the
Transport Agency conducted audits of all testing officers. However, for
the last 2 years, the NZ Driver Licensing Ltd commenced a significant
audit program of its own, which the Transport Agency monitors.  This
includes some covert surveillance auditing, camera footage of some tests
and a detailed audit of test papers. 

 

To date, there have been no customer satisfaction surveys. However, the
Transport Agency is currently developing a customer satisfaction survey to
help identify areas for improvement.

Dear NZTA,

I suspected that providing data in tree like form might require substantial collation or research. Hence, I provided the option of providing anonymous test data in a table format. As you'd have to have such data readily available to compile the data in a particular statistical form (which you've done). As a matter of practicality, providing data in a table format would require less collation or research than for the statistical form of data you've provided. Your statistical form of data doesn't provide the information I'm looking for as I've outlined earlier. Generating pseudo ID does not require substantial collation as you've proved by providing anonymous unique numerical ID's for testing officers in your initial response. If this a problem let me know. Therefore, I do not agree that my request would require substantial collation or research.

In regards to section 18(f), privacy, I've explicitly stated that no private information including name, address, driver license number need not need to be provided. I've detailed what information is required and I've never asked for private information. Please advise me as to what part of my request pertains to private information. Hence, request for anonymous test data in not in breach of section 18(f).

You've not provided a reference to any section(s) of law that entitles you to refuse request because such data would "prejudice the interests protected" nor have you stated what is the concerned interests. I do not think anonymous driver testing data is a state secret or commercially sensitive data.

I've asked for details of paper audit (refer to my October 25 message) not kinds or types of audits. You've stated the types and kinds of audits in your initial OIA response. It may be that you do not have all the details of paper audits to grant my request as it is conducted by your contractor. I'm not sure as to whether information held by a contractor is covered under OIA. Please provide as much information you can to answer my OIA request. I will have to confirm legal grounds for OIA request involving information held by contractor.

Thanks for your timely reply.

I'd be happy to provide you with a phone number, however, it is unwise to do that through this public forum. In addition I need to be able to keep written records of all conversations, also there are other people who are interested in this OIA request (number of followers) who needs to be kept informed - can only be done through this website. Hence, a communication medium other than this website in not an available option.

To recap what I asked for is practical driver testing data either in a tree-like statistical form or in a table of anonymous raw test data.

I understand that providing data in a tree-like statistical form would require substantial collation or research. So please provide the anonymous test data in a table format.

This how the anonymous data in a table form should look like: a row of table for each unique practical test taken. A column for each for the following information:

(a)An unique candidate ID (anoynomus).
(b)The date when the test was conducted
(c)The Type of test - restricted/fulll.
(d)An unique testing center ID and/or name.
(e)The birth year/age of the candidate (age bracket would suffice for more anoynomity).
(f)The gender of the candidate.
(g)The result - pass / failed.
(h)The type of failure (e.g. immediate or critical) (optional).
(i)An anonymous (pseudo) ID of the testing officer.
(j)The overall score (optional).
(k)Comment of the testing officer (optional).

Any of the column indicated as optional need not be provided if it would require substantial collation or otherwise would lead to the denial of this OIA request.

The period covering the practical test is stated in my initial conversation for this request.

In regards to the audit information you've provided, would that be possible to provide data for the period 01-Sep-2012 to 31-Aug-2013, as this period matches the period of driver testing I requested. You've provided audit data for period Jan 2013 to Dec 2013 already, so may only need to supply data for 4 months (Sep 2012 to Dec 2012). I understand that I may have not explicitly stated the period of audits.
