Dear New Zealand Police,

I am a NZ citizen residing in Lower Hutt.

I recent laid a complaint of theft against Mr Chjristoper John BATES and his company On-Line Digital Solutions trading as OPEN2VIEW.COM. The case number is 190628/7295.

I provided evidence of the crime. I provided the name and contact details of the offender. I provided police with a summary of the facts and the information that would assist them in proving the offender was guilty.

I am requesting a copy of all files, documents, notes, emails, and other communications relating to this case and the decision not to proceed with a prosecution.

Kia ora Mr Sanders

 

The Office of the Ombudsman contacted New Zealand Police today to advise
that you have made a complaint that you did not receive a response to your
request logged with New Zealand Police on 9 October 2019.

 

New Zealand Police have investigated and provide the following
explanation:  

 

 

o You made two identical requests for information on 9 October 2019 at
6.57am.

 

o These were logged as Privacy Act requests on the Police Information
Request Tool database on 11 October 2019 under record number
IR-02-19-5934 and IR-02-19-5932.

 

o Work log records note you were emailed by Police on 11 October 2019
and again 16 October 2019 to provide identification in order that we
can progress the request, however no reply was received from yourself.

   

o You were then emailed by Police on 29 October 2019 advising that we
had not heard from you and still required identification to release
any information so Police would be closing the two requests and if you
still require the information to please reapply and be sure to include
your identification with the application.  

 

o The requests were closed on the database on the same date.

 

o The emails were sent to [FOI #11418 email]

Are the NZ Police within their rights to ask for proof of identification before fulfilling an OIA request, when they have previously completed a seperate request made by the same individual?
The NZ Police completed an OIA request made by Nathan Sanders on the 5th of July 2019. https://fyi.org.nz/request/10602-police-.... Presumably this shows that the NZ Police are satisfied with Nathan Sanders' eligibility, correct?
