My preference is to receive the requested information by email.
Section 158 of the Local Government Act 2002 requires a bylaw to be reviewed no later than 5 years after the date on which the bylaw was made.
Section 159 of the Local Government Act 2002 provides a local authority must review a bylaw no later than 10 years after it was last reviewed as required by section 158.
Section 160A of the Local Government Act 2002 provides that if a bylaw is not reviewed as required it will be revoked 2 years after the last date on which the bylaw should have been reviewed.
According to information earlier provided by the DCC the 2004 Dog Control Bylaw was made on 16 August 2004, effective September 2004. That means the bylaw was required to be reviewed no later than 15 August 2009 or it would have been revoked in 2011.
Accordingly could you please provide:
(a) Council records that conclusively show the 2004 Bylaw and Policy were properly reviewed no later than 15 August 2009.
OR:
(b) The reasons (and supporting evidence) the Bylaw and Policy are exempt the s158 requirement for a five-year review so there was no requirement to perform it before the 10 year review.
AND
(c) Council records that conclusively show the 2004 Bylaw and Policy were properly reviewed no later than 10 years after they were last reviewed.

I am responding to your LGOIMA request, received on 28 May 2019
requesting:
(a) Council records that conclusively show the 2004 Bylaw and Policy were
properly reviewed no later than 15 August 2009.
OR:
(b) The reasons (and supporting evidence) the Bylaw and Policy are exempt
the s158 requirement for a five-year review so there was no requirement to
perform it before the 10 year review.
AND
(c) Council records that conclusively show the 2004 Bylaw and Policy were
properly reviewed no later than 10 years after they were last reviewed.
I can advise that we are finishing our review of the information required
and will endeavour to have this to you be the end of next week ( 5 July
2019).
