I refer to your requests below.

 

That paper is still public excluded and so withheld for the reasons given
at the meeting, which you will recall related to s7(2)(b)(ii) and 7(2)(i)
LGOIMA which relate to unreasonably prejudicing the commercial position of
the person who is the subject of the information and enabling Council to
carry out, without prejudice or disadvantage, negotiations. We do not
consider there are reasons in the public interest that favour release
here.  You have the right to complain to the Ombudsman. 

  

As discussed in the public section of the meeting, the primary concern for
Council is that is currently in negotiations with the Event Centre
operator with regard to its draft business plan (including the projected
underwrite).  For clarity, this relates to the underwrite for the second
year of operating and not the first year.

Hi Matt

I've followed those questions up and understand the negotiations are still on-going at the moment with no fixed timeframe. I don't know the answer to the other 2 questions yet.

On a side note, we are getting requests relating to requests now, ie. Requests about information requests. Do you have any issues with your details (name and emails on the requests) being released as part of these?

Hello Matthew.  In regard to your OIR regarding the Events Centre, the
following information is provided:

 

1.       We can confirm the negotiations have now been concluded.

 

2.       The budgeted figure for the Events Centre underwrite in Council’s
2019/2020 budget is being withheld as it is necessary to protect the
information as making it available would be likely to unreasonably
prejudice the commercial position of the Events Centre pursuant to
s7(2)(b)(ii).

 

3.       We cannot disclose the budgeted operating results for the
2019-2020 financial year as that is information held under an obligation
of confidence pursuant to s7(2)(c)(i). Further as it is necessary to
protect the information as making it available would be likely to
unreasonably prejudice the commercial position of the Events Centre under
s7(2)(b)(ii). For these reasons the expected deficit with the Event’s
Centre Operator’s business plan is withheld.

 

You have the right to complain to the Ombudsman.

Hi Matthew. The advice that I have received from our legal counsel is that the emails relating to the decision to refuse this request are to be withheld in their entirety. They are all subject to legal privilege and accordingly are withheld under section 7(2)(g) of LGOIMA.
